Failure to pay for all damages caused when a Fred Loya insured vehicle rear-ended me and forced my vehicle into another vehicle

On Sept. 29 my vehicle was rear-ended by another vehicle covered by Fred Loya Insurance while I was stopped in traffic in San Antonio. Upon impact, my vehicle was forced into the back of a vehicle in front of me that was also stopped in traffic. My vehicle received damages to the back and front bumpers because of this and the vehicle in front of me received damage to the rear bumper. The driver of the Fred Loya insured vehicle that hit me first, apologized and admitted fault.

Claims were made to Fred Loya Insurance immediately by both myself and the owner and driver of the vehicle that was in front of me. Originally, the claims representative at Fred Loya, Romeo Trevino, told me that there should be no problem since I was rear-ended and the subsequent impacts and damages were caused from my vehicle being hit from behind first by the vehicle covered by Fred Loya.

Several weeks later on Oct. 11 I received a phone call from Mr. Trevino saying that they were only going to pay for the damage to the rear of my vehicle because there was a double impact (which was news to me). Later, I learned that they also refused to pay up on the claim made by the driver of the vehicle that was in front of me. After talking to my own insurance person I was told that Fred Loya Insurance was saying that the driver of their insured vehicle said that he saw me hit the vehicle in front of me first and then he hit the rear of my vehicle. This was completely untrue and my insurance person said that after talking to the driver of the vehicle in front of me and his passenger that they both supported my claim that I was rear-ended first by the driver of the Fred Loya insured vehicle.

However, she also told me that Fred Loya Insurance is "not listening" & so far, they have not responded to my e-mails. Mr. Trevino said he was going to call me back when I last talked to him on Oct. 11th, but, of course, he never did! I have heard Fred Loya is notorious for doing this kind of thing to claimants. It's hard enough being the victim of an auto accident and now Fred Loya Insurance is trying to victimize us twice by not properly settling these insurance claims!
