Ripoff contract and warranty fraud

On 6-11-01, I purchased an Isuzu from Checkered Flag stipulating that I had to have an exteded warranty and GAP policy. Contract was written and I signed the contract in good faith. Car was financed through Capital One for $347 a month.

On 6-28-01, I had to return to dealership with more down payment and to sign a new contract through Capital One where I was told by the finance manager, Mike, it was just to lower my monthly payments from $347 to $327. Contract was signed and I assumed all was right.

On 1-23-03, the car was totaled and I am now being told the GAP policy that I purcheased for $300 was excluded from the second contract, because Capital One would not approve this policy, but Mike did not tell me this. He said the second contract was only to lower my monthly payments.

Now, after going around and around with Checkered Flag for two weeks, I am told by Bob Abbate, Scott and Jason the now finance manager, "Tough luck". Since I just now realize they excluded my warranty and GAP policy from the second contract.

Now, Capital One is calling my home 3-4 times a day demanding payment of over $2000 that my insurance company did not pay off. Since neither the sales person nor the finance manager Mike no longer work for Checkered Flag (Mike was fired) Checkered Flag should pay Capital One what is owed.

I feel when a customer goes into a dealership with certain requirements on purchasing a vehicle, these requirements should be respected. Therefore I hold Checkered Flag 100% responsible for the payment of this $2000.

Since no one working there now worked there three years ago and since Mike WAS fired for who knows what reason, Checkered Flag, Bob Abbate should fork over the $2000. After all, $2000 is a drop in the bucket for them to rip-off another customer.
