Criminal - the best way to describe what they did to me.

I am a disabled US Navy veteran, small businessman, dedicated father and community volunteer. Point - I am well known and I take care of business and my family. I would Never have dreamed that a local businessman could be so hurtful or hateful in their actions and lies in business - but this guy takes the cake.

I took my car in to KS Auto Sales to get a bid for repairs. I did not sign contracts or otherwise. I was called by them weeks later saying they had the parts (though I had not ordered or contracted for them). They began harassing me - so I told them I was going to use a different vendor instead. They then proceeded to cause a lot of disruptions to my business, my personal life and now, my credit.

They hired a collection company to sue me, claiming in excess of $800 in damages - I responded to each complaint with calls and written letter - none were answered. I was prepared for court - they were not. I was told by their attorney it was a futile case for them and would certainly be settled out of court - so I allowed them time to answer my requests for documents and interrogatories I filed with the court (they did not expect that I would actually answer that false law suit). They could not produce any invoices for parts, paint or otherwise any claims of costs associated with me. They did not do any work on my car.

I offered to settle with them if they had the part - I would buy it at cost and take to a different shop to be installed on my car as I did not trust them any longer. They refused to provide invoices or proof that the part (bumper for my car) actually existed and refused to allow me to pick it up and pay for it - even though I had not contractual obligation to do so.

I informed their attorney (on the 3rd trial date - I went to all the other ones and they were not there) that I had to drop my children off at school at 9AM so I would be a few minutes late. It was snowing too that day. I got there 15 minutes after 9AM and a default judgment was already placed - despite having filed my answers with the court and being assured by their collection attorney that it "was not worth his time" to even purse and was laughable to say the least.

They continue to harass me and refused to settle. Now I have a judgment for more than the total costs of the parts and repairs, attorney fees - despite the fact that KS law says they can not claim attorney fees unless there is a contract that says you can - which there is not - and I have spent a small fortune trying to resolve the matter without expensive attorneys... Their attorney egged me on and lied to me saying it would be resolved without court judgment and that he would advise his client to accept my offer to pay for the part - but my stipulation was that I actually GET the part in usable condition... They refused... Rather I think they never had it and only intended on extorting money from me as they have done to others.

Overview:
I took my car to KS Auto Sales shop for bid on getting bumper replaced (I damaged it in a parking lot by pulling too far forward and cracking it on the curb.

Kyle (manager/owner) gave me a price of $600. I said it sounded fair and that I would probably do it.

On a side note - right afterward I found out that I was to become involved in 2 other lawsuits unrelated to this matter (business and tenant issues) - so I called the guy and asked to postpone getting it installed. I did so several times.

Evidently he ordered the bumper and was ready to install it. He claims to have painted it already too. I think that is a lie.

He got upset at the delays and instead of trying to figure out why - he got very pissy with me - so I told him that I was not going to do business with him. He cursed a little and then we hung up. A month later he had a collection company send me a demand letter for I think it was $750 to which I replied several times and called that company as well as KS Auto Sales. I told them all that I did not owe the money - no services were rendered and that there was no contract between me and him. I never signed anything.

I did offer to pay for the cost of the bumper and the paint job but that since he was going down that road I refused to give him further business so I wanted to pick up the part and have them installed at a different body shop. He said he did not have the bumper any more - but still claimed that he was owed extra for me not coming in as he had thought I agreed to do.

I feel bad - but at the same time - no services were rendered and I found out he is not an honest person to do business with. He hides a lot of repairs and such on his cars he sells. He repaired a truck I own that one of his cousins ran into - did a terrible job on it... But got paid insurance money for it... I should have learned my lesson then...

If they will deliver the bumper free of defects that I can use still - I will pay his costs - should be around $125 for the bumper and $100 for paint. If he wants this $675 plus interest as the lawsuit claims - he's nuts.
