Breach of Contract

January 18

On January 13, I received an email from Eric Jeffries in regards to the remaining balance of $6,000 of $1,000.00 owed to him on the 1999 Lexus GS300 on a. The email is as followed: Certified Letter Eric Jeffries dba A-1Insurance Services Please be advised that this is an attempt to collect a debt due in regards to the purchase of a 1999 Lexus GS300. According to the agreed upon terms, you are currently in default due to a past due amount of $1000. The past due amount must be received on or before January 23 or be subject to repossession. If the vehicle is repo'd, it will be subject to a repossession fee of $300. Since this is a down payment default, you will be entitled to a partial refund. If the vehicle is repo'd after the scheduled first payment due date, January 23 you will not be entitled to a partial refund. Best regards, Eric Jeffries

I emailed Mr Jeffries on January 14 to inform that I will need a copy the dealer contract given due dates of when the first car payment is due and the end date on when the last car payment will be expected. I also informed Mr Jeffries to please contact me Via phone to discus the issue or the communication disconnect. Countless time Mr Jeffries refused to comply, and would informed me that email communication is what he prefer. These email continued until January 15, again with no verbal communication between Mr Eric Jeffries and me. An email was sent to Mr Jeffries from me at 10:56am on January 15 again asking for written documentation with due date and a verbal open line of communication. This again Mr Jeffries refused; I received an email from Mr Jeffries at 4:10pm January 15 informing me that I owe the $1,000.00. At no time did I deny payment of $1,000.00 to Mr Jeffries in any of my email treads. I walk out to the parking lot at 5:15pm on January 15, only to find that the 1999 Lexus was not where I parked it that morning. I contacted the RRPD to file a report on theft only to find out that the car was repossessed by Mr Jeffries 8 days before that give on him January 13 email. This was done with out notice to me prior and Mr Jeffries have clearly breach a email contact and date that he submitted to me on January 13. I informed Mr Jeffries to return my personal items that where in and on the vehicle and also a full refund of my $5,000 that I vested in a vehicle that he now has possession of.
