Deldar Alizada, Refusal to honor warranty on engine

I purchased an engine from JDM Tech on Forsyth Rd, Orlando on 08/05/09. The invoice states 30-day warranty. I paid $500 cash for the engine. I installed the engine (I am an ASE-certified Master Tech), and when I tried starting it for the first time, it started but ran poorly and knocked.

I immediately shut it off and removed the valve cover to discover two valves were bent. I drove over to JDM Tech and informed David aka Deldar Alizada of the situation. This was 3 weeks after buying the engine, well within the warranty period.

He said he would come out to my house and inspect the engine, which he did two days later. He took pictures of the engine serial number and the damage.

He told me to remove the engine and bring it back, and he would give me a replacement. Due to the extensive labor involved in removing the engine, I offered him to settle by asking for a partial refund in the amount of $150 which would cover the parts to repair the bent valves.

It took David more than a week to get back to me, although I called him every day for an update. Finally he called and said that his boss would only authorize $80 refund. At that point I told him I would just return the engine. We were now past the 30-day warranty period.

After weighing my options, I decided to repair the engine and not bother to collect the paltry $80 offered by David. When I took apart the engine to repair it however, it was evident that the engine had much more extensive internal damage than the two bent valves that were visible from the outside. It was beyond repair. This was 12/08/09.

I drove to JDM Tech to tell them about it, and David was not there. He was in Calgary, Canada. I spoke to Homayon Wahidi, who took a hands-off approach immediately and told me that since David sold me the engine, I could only deal with him directly. Up until this point I have been nothing but polite and diplomatic with JDM Tech and its representatives, as I feel it is in their best interest to make good on this issue.

I explained that the bottom line here was that I paid $500 and received an unusable piece of scrap metal, and I would like to either be refunded my $500 or given a good engine, very simple. Wahidi gave me the phone number for David in Calgary and I called him on the spot.

David answered the phone and proceeded to tell me that the warranty is expired, tough luck and hung up on me. Wahidi continued telling me that he has no say, and that David is the boss. Great customer service right?

This morning, Wahidi called me to inform me that David called him and told him that the warranty is expired and there is nothing they can do for me. I said OK, and that I would be taking legal action.

I researched the company information and found that David aka Deldar Alizada's name is not on the company's registered profile, but Wahidi's name is. I visited JDM Tech again today and spoke with Wahidi to confirm his identity and informed him that since I will be suing JDM Tech, and David's name is not on the company registration, that the court summons would be addressed to him, Wahidi. He immediately got on the phone, and at that point I said "See you in court" and left.

This company sold me a defective piece of merchandise and then refuses to stand by their warranty. As promised, I will do everything in my power to recover my losses AND notify as many potential customers as possible of their unethical business practices.
