Midwest Auto Recyclers sold a defective motor, advertised as perfect with Warranty

I called the number supplied at their Website to inquire about a replacement motor for my vehicle. The company confirmed that they had a used 6cylinder for Toyota Landcruiser motor for my vehicle with only 47,000 mile on the motor it was coming out of a rear ended vehicle, They assured me it was a great motor, additionally The company informed me that the engine came with a 180 day warranty but that if I agreed to purchase that day they would through in a three year 36,000 mile warranty at no additional charge (a $450.00) value.

When the paperwork arrived via internet it broke out the engine as one charge $2,345.00 and the warranty as another invoice with a Charge of $150.00. They explained that to validate the warranty it had to be seperated.
We purchased the engine and warranty and it arrived within the two weeks. We installed the engine per the paperwork agreement and within three days of delivery of the engine had it up and running.

Immediately my mechanic noticed a knocking in the engine, he notified the company and spoke to the parts department. My Mechanic told them that it was apparent that the original accident this motor suffered in the wrecked vehicle had sheared off the power steering pump which is mounted directly to the engine block and run off the internal gear driven off a counter gear from the timing gear. They informed the mechanic that we had to activate the warranty which would take two weeks you could not activate the warranty until you installed the motor. The Parts tech told the mechanic he would work with him as soon as we followed the warranty.
We followed the warranty rules and regulations and waited for a liqued product to arrive that we had to add to the radiator and run for 500 miles to determine if this would fix the problem.

Upon doing this we called the company back to inform them that this did not work and that the engine had to be broken down and the gear and timing Chain had to be replaced.

The Company's stand was that they bo not guarantee timing belts. We tried to explain that this motor does not have an external timing belt but in fact has an internal Timing Chain good for the life of the motor. Again they responded they did not coever this under either warranty.
According to the terms and Conditions that I agreed to on the paperwork I signed with my invoice the following TERMS AND CONDITIONS:

1. We do not warranty oil leaks on engines or transmissions due to non replaced seals and gaskets.
2. The engine warranty covers block, heads, and all internals.
3. We are not responsible for improper installation and or labor charges.
4. Warranty will void if the part is used for racing, operated without proper fluids, or a melted heat tab.
5. Definition of an engine assembly is block, heads, and all internals.
6. New thermostat and timing belt (if applicable) must be installed.
7. All returned parts or cancelled orders are subject to a 25% handling and restocking fees plus customer assumes all shipping costs.
8.in the event that the buyer defaults in the terms of payment, the buyer agrees to reimburse Midwest Auto Recycling for all costs and attorney fees it incurs in collection action.
9.180 day engine warranty.
10.90 day transmission warranty.
11. We do not assume towing, shipping, transportation, and car rental cost.
12. Usual delivery time is about 10-14 working days but due to some unusual circumstances please allow additional time.
13. Extended warranty will be activated upon notification of installation of engine.
14. Engine or transmission must be installed within 30 days of delivery.
15. Make sure to inspect all parts before signing for them on delivery.
16. This Agreement, including any amendments thereof, verbal or written, shall be governed by and interpreted in accordance with the laws of the State of Wisconsin and sole jurisdiction and venue for actions arising out of or related to the subject matter of this Agreement shall be in State Court in Milwaukee County, State of Wisconsin.
Note item 2. It says that the engine warranty covers Block, Heads and all internals.
Note item 6. Says that a new thermostat and Timing Belt (if applicable) must be installed.
No where does it say timing chain an "internal engine part"
My mechanic has clearly tried to work with them but they state the same thing every time that is not covered.
So This Company sells bad engines and then does not honor their warranties.
They try to twist the English Language to their own ends.
Timing belt are an external part that have a serviceable life span. This means the belt is not internal to the engine and is required to be replaced per manufacters specification IE at 60,000 or 90,000depending on Manufacturer.
Timing Chains are an internal working part on an engine and do not require replacement until the engine has to be rebuilt, if at all.
From another complaint I read on this site it would appear that this company is the same company he referred to in his report #277286 Also known as Mid City Auto Salavage.
Buyer please beware of this company. No wonder the world hate americans with people like this claiming to be businesses.
