Forged My Signature on Extended Warrany Application and Scammed Me out of $262.00

A friend and I went to Eddie Accardi in Pompano Beach, Florida to each by a new Subaru. However, the day after purchasing the cars, I noticed they stuck me with the highest finance rate rather than the lowest one as I had requested. I should have noticed this at the showroom but I did not notice it until the following morning. I called Mitch Loszynski, the finance manager and he gladly offered to redo the financing. All he asked was that I later stop by the showroom.

One day later, I stopped by the dealership and Mitch was busy with a customer. But he briefly waived and said, "Neal, you're all set... I took care of it over the phone." I did not give it a second thought, (though I should have,) and went home. One week later I received a Subaru "extended warranty" agreement in the mail. The certificate showed that I had paid a total of $262.00 for the warranty. The reason for telling me it was done over the phone, was so I would not see the $262.00 charge for the warranty. (I eventually did get a copy which proved it wasn't done over the phone and also proved that the $262.00 charge was indeed on there.)

Even though the finance rate was lowered, the "total amount financed" should not have changed. I called Mitch and asked for that figure and it was $262.00 higher than on my original finance agreement! The next thing I did was to stop by and talk with Damien Thompson, my salesman. I asked why Subaru sent me an extended warranty and he said it was a free gift. I asked, why then, does it show the amount I paid plus the tax? He replied, They have to document it. I knew the guy was lying through his teeth but I thanked him for the information and then sat down to talk with Mitch. I told him I had been scammed and he tried to explain how this was indeed a free gift that had gone awry. Mitch explained what supposedly had happened and at that point, I then knew he was in this thing up to his eyeballs. When we finished talking, he said, Neal, I've been totally honest with you and if you don't believe me, I'll take it as a personal insult. He also said, I swear on the lives of my two daughters that I have been 100% truthful. The blatant lies told to me, by both of these crooks, were a total insult to my intelligence.

During this time, I had also been communicating with Subaru's customer service. Fortunately for me, they have great people who were instrumental in helping me find the smoking gun, the evidence I needed to nail them. I found out that for anyone to obtain an extended warranty, they must sign an extended warranty application. The people at Subaru told me the form did indeed contain my signature. At that point, I just had to get hold of this document. Finally, my main contact at Subaru faxed the smoking gun to me. Not only was my signature forged, but both my first and last names were misspelled! Mitch had sworn to me, on the lives of his daughters, that he, (nor anyone,) had signed my signature on that document. But he changed his tune when I threw the application down on his desk, right in front of him. Finally, I caught this liar with his pants down! All the Mitch could no longer deny that he had forged my signature for the sake of cheating me, he still claimed it was an innocent mistake.

Originally, I had planned on pressing charges and going all the way with this thing. But in the end, I was totally drained from this ordeal. It had gotten to the point where I couldn't even think about anything else. Therefore, I thought it best to accept a modest settlement and just be done with it.in Florida, forgery is a felony, not to even mention the crime of defrauding a customer in the first place.in addition, this was a conspiracy to defraud since both the finance manager and the salesman were in on it together. I would have thought that, at the very least, I would have received some sort of follow-up or apology from either the owner or the general manager. At least then, I would feel as if they cared. But except for my conversations with the finance manager, (the primary perpetrator,) I never heard from anybody. Neither one of the two culprits even lost their job. Although this happened in December of I have seen both these guys there, numerous times, while getting my car serviced. Nobody should even consider buying a car at this place, not under any circumstances.
