Paid for a vehicle that was never delivered

My husband and I saw a 2002 Silver Toyota Rav4 with stock #0155 on www.cars.com. We got the contact which was 5164884150 and called. Frank received the call and we discussed with him. We also got his e-mail and sent him a mail asking is he could bring the price down and he should also send us his account details for the wire transfer. The initial price on the website was $9995 but he agreed to give it to us at $9200. He forwarded the account details below: Correspondence Bank: HSBC Bank, New York Swift Code: MRMDU33 ABA No: 021001088 For Credit of: Guaranty Trust Bank PLC, Lagos Nigeria Swift Code: GTBINGLA Account Number: 000156442 For Final Credit of: Olufemi $ Ogechi Ojo Beneficiary`s A/C No: 210 738639 210 (with GTB) We also told him that we`ll be transfering $5000 and will do the rest by credit card and he agreed. On the 3rd of Sep, we transfered $5000 and called him to inform him. We also asked to give him the credit card details over the phone so he can process it but surprisingly, he said it was against the company policy that they do not accept credit card. He acknowledged over the phone that he had received the money and we requested for him to write an acknowledgement stating that he received the said amount, this he refused to do. We sent him a mail on this issue but he never replied nor acknowledged in writing that he received the said amount. We said to him that we do not have the immediate cash for the balance and he said we could send it whenever we could. On the 14th of Oct, we transfered the balance of $4200 and called to speak with Frank to make arrangement for the shippment but surprisingly, we were told that Frank no longer worked for the company. The next day, I called back and Mike, who introduced himself as the owner of the company was over the phone. I laid the complain to him but instead of offering a solution, he was screaming at me that he knows nothing about the transaction, that I don`t have any proof of the transaction, that he could refund the $4200 but won`t refund the $5000 because the company policy says that deposit should not be held for more than one month. I told him that the proof we have is the e-mails and the duplicate copy of the form we used for the transfer. After much arguement, he said he would offer us another Rav4 and that since he didn`t have one at the moment, he would ask his friend. He later said his friend had one for $13,500. I told him we wouldn`t do such ridiculous amount for a 2002 Rav4 and we requested to have pictures of the vehicle before making an offer. His friend Joe sent the picture and quoted the price at $13995. I called Mike back to say the best we could do is $9800 which is the average price of such vehicle and that we had done a research on it. Surprisingly, instead of saying something good to help the situation, he started saying that he doesn`t have our money that we can go ahead and negotiate with Joe and settle the price with him. I told him that we do not have any business with Joe but with his company, he said we could do whatever we wanted to do. He later said I should forward him the bank details Frank sent to us so he can take a look at it. I forwarded it to him but he kept saying he will get back to us as soon as his accountant confirms the payment but till date he hasn`t gotten back and does not respond to his calls or mails
