(car Dealership) lied to my co-signer - will not give me my down payment back even though the deal was never finalized

I went to Kia to purchase a used car. They convinced me to purchase a brand new car that was actually more than I was willing to pay each month. They said I had to get a new car with a warranty because the bank would not approve me for a used car.

While my credit is not perfect (only average.) my aunts credit is great and she agreed to so - sign for me.

My Aunt had initially agreed to co-sign for me on a cheap used car. When they contacted her with the figures. They apparently told her the figures on a used car that i didn't even want (had not even test drove), then sent her the paper work on the '09 Kia Spectra. All the while telling me that they have been talking to her the whole time and that she agreed.

Well, when my Aunt received the paper work... She flipped out and shredded the papers because this is not what she agreed to, and then refused to do any business with Kia. And she told me to return the car and get my money back and we would go some where else.

So, I went to Kia to return the car because my Aunt would not co-sign. They told me to keep the car for the weekend because they were sure they could figure out some way for me to keep the car. I told them that I did not want to leave in the car because I was sure they couldn't change my aunts mind. And I did not want to be responsible for additional miles that would be put on the car over the weekend because I do so much commuting. They told me not to worry about it and to come back Monday.

So I came back on Monday. My aunt still said no and wouldn't sign. So they said, that's fine we'll just give you your car back. I said, I didn't give you a car, I gave you cash. He says, well you can just consider that lost. Well, what is the difference of giving me a car or a few hundred bucks? All I want is my down payment back so that I can go somewhere else to get a car.

They have no paper work regarding this deal. I, on the other hand, I have the only paper in existence on this deal. I have the closing statement that says I paid a down payment. I gave them their car back I just want my money back.

The deal was never finalized. They let me leave the car lot in the car, not having both parties signatures and with out having insurance. That was their choice. I had to go the next day and get insurance. I tried to bring the car back and they told me to keep it for a few days. I willingly gave them their car back and they should give me my money back.

I have continued to be polite and respectful with them... And today I went in to talk to the owner, he was very rude and he told me to get off his property. So I left.

They knew this was my first time buying a car. And my co-signer lives out of state. I personally feel that they were intentionally trying to take advantage of me.

I have talked to many people about this. And everyone, including the manager at another car lot, agree that the dealership is in the wrong and should give me my money back.

And because of this I have already had to miss a lot of work. Because my job is so far away from my home I have no way to get to work some times. And I'm also out the money I put down for insurance. I have insurance and no car.

I intend to pursue this in small claims court. And I recommend that no one do business with this company.
