To Whom It May Concern:

First of all let me explain that I have to give you approximate dates as I no longer have the paperwork and this will be explained as you read.

I know it was on or about the first week of Sept that I bought a truck from Lopers Auto Sales, 1620 - 13th Street, St. Cloud, Fl. Phone 407-957-6771. I traded in my Mazda pick up for a work truck as I spend most of my time landscaping. I know the time because 2 weeks after purchasing the truck I had to go to Canada as my grandmother was dying and subsequently died. On the way home from the sales office I noticed that the odometer did not work and then the brakes were leaking all over the driveway. I called to complain and told them that I would have to return the truck for the necessary repairs. The response was not complimentry nor helpful.

I made 2 payments at once and then my grandmother died as I said on Sept 27th and I had to gone to Canada for the funeral and subsequent family time. I notified the shop before I left telling Ron the owner and his wife both, that I had an emergency and had to leave Florida for a short time.

When I came back Oct 3, after the funeral, the truck was gone. It had been repossessed. I called to see what had happened and was told that I was not welcome to the property.

I do not know why. I told Rons wife that all my personal belongings were in the truck including my paperwork for the sale and my receipt etc. And I was told that they had thrown out my personal belongings. I asked about the truck and they told me that they had sent it to the auction to be disposed of.

I was very concerned as my tag was on the truck. My sister is an attorney in California and she told me that for them to take my personal belongings and my tag, as well as, disposing of the truck in that short period of time was nothing short of illegal. I tried in every way to reason with them and told them I had my grandmothers death certificate to prove that I had a legitimate reason for leaving the country and not being available to pay the next payment on time but to no avail.

They continued to refuse me entry to the car lot to regain my personal property or give them the death certificate as proof of my absence.

My sister, as I said, is an attorney in California and she tells me that what has happened is definitely illegal. I was not offered an opportunity to pay, all my personal belongings were absconded and discarded, and the Mazda I traded has recently reappeared on the lot after a lengthy disappearance!

The bottom line is that this dealership sold me a malfunctioning truck, then repossessed it, and kept the other truck as well.in other words they made out like a bandit! Two (2) trucks for the price of a missed payment due to a family death. I ended up with nothing, not even my personal belongings. My sister tells me that this is not acceptable business practice.

She thinks they should return my old truck to me and compensate me for my personal belongings, my briefcase, personal papers, tag information, CDs, jacket, calculator and more.

I am going to try to take this case to small claims court as soon as I am financially able, but sure could use some help in the meantime and perhaps avoid any further expenditures by your investigation team.

My problem is that they kept all my paperwork so I have nothing in my hands as proof. I do have a witness to the original transaction, her name is Shelly Jackson. Shelly will attest to my above description of how this transaction unfolded.

It is going to cost me over 100.00 just for a new tag and because I cancelled my insurance, I am going to have to pay another start up fee in excess of 300.00. All because there was no reasoning with Ron or his wife. I dont understand why they did this to me at all. I was not difficult and tried my best to reason.

Problem is they took all my paperwork, I paid cash and they took my tag, some clothes, my briefcase, CDs and my insurance information as well as my registration information. This has just been an unreal situation.

I hope that you are able to help me with this situation. Please respond if you are able to help me in any way. I am also reporting this incident to the Better Business Bureau and the Dept of Motor Vehicles.
