On June 16,08 I went to my local GMC car dealership on RTE 46 E to look at an ENVOY Truck. My sales man name is Jim Cipolla, he told me they do not have any ENVOY Truck on their lot, but he could get one from another dealer for me. I said OK, so he went on their computer to search in their inventory to see which dealer might have ENVOY Truck. He give me three print out of ENVOY Trucks with discription of them I told me I would like to see they one that comes with sunroof and runnings boards, he said OK. Mr. Jim then told me I have to give a deposit to run my credit for approval, I told him if approve and I decided to purchase my payments MUST be $500.00 a month for 60 months again he said that will not be a problem, so I offer to give him $100.00 and he said 'NO' I have to give no less than $500.00 which is refundable, I ask him again is my deposit refundable, 'he said YES'I ask him to give me something in writing so he wrote on the deposit application, 'deposit refundable if payments not $500.00 a month or decline' At no point of time did Mr. Jim Cipolla showed me any written policy that my deposit was not refundable also he never mention that I will he held liable for all expense if I choose not to buy the vehicle.
When I saw the vehicle it wasn't what I expect and wanted, also my payments was over $500.00 a month, and it was for 72 month. I then refuse to purchase and ask for my $500.00 deposit back, I was told 'NO' I cannot have my money back, I ask to speak to the Manager who's name is Brian, he refuse to give me back mu deposit, he told me to call him within 24 to 48 hrs and he will see what he can do, which I did. He did not want to speak to me I had to put my husband to call, when he came to the phone I said I would like to have my money back or I will report this to the BBB and he treaten me by saying if I report this to any one he will make sure I do not get my deposit back and he would have to use the $500.00 for all expense and interest having to keep the vehicle. After making several attemps to reach the GM I finaly spoke to him on Monday July 7,08 he also refuse to give me my deposit back, he then said he will speak to Brian the sales manager and have him call me. They never contact me again. For all the above reason I know I'm entitle to my money back, there are no sign agreement with the vehicle and no sign documents showing or proving that my deposit was a non-refundable. The only sign document is the credit application. Please help me to recover my money, attached is copy of the credit application.
