My Truly horrible experience buying an Infinity FX 35

My wife and I decided to get a second car due to the fact that I was starting a new job in Virginia to head up efforts for the design of Satellites where I would need a car. So since this job was a significant increase in salary and my wifes business was also picking up we decided to go with a car we had been wanting for a long time an Infiniti FX35 with GPS navigation.

Negotiation on the vehicle started on Thursday evening, September 20th when I spoke with Cleiton Silva over the phone about leasing a FX35 with navigation for my wife. At the time he told me that he could get a good deal on one and told me to come. He said that the price was in the four hundred and something range. When I arrived at the Kelly dealership in Danvers on Friday evening Cleiton told me that the car that he had for four hundred and something dollars a month was actually a GX sedan, at that time I told him that I wanted a FX35 and was not interested in the GX. Then he took me on a test drive in a white FX with the nav package and after test-driving the car I told Cleiton that I wanted the exact same model in blue. I then asked him about the 2007 model that he had mentioned and he told me that the 2007 model was grey and it had a lot of extras that I did not want, like 20-inch rims and an Ipod feature, and also it was grey.

All of the negotiation was done between Cleiton, my wife and I in Portuguese. Cleiton gave me the price for the car, he told me that he had reduced the price below the invoice level and that the dealership was actually pricing the vehicle with a slight loss. I said thanks and then I went to the business office to take care of the paper work.

I left on Saturday to drive to Virginia and the car was delivered on Monday early evening. On Sunday I spoke with Cleiton and asked him to show my wife the features of the car when he dropped it off, and teach her how to use the GPS so that she would not get lost. He said ok and said that he would call Monday, morning about the insurance. My wife was ill and preparing to travel to Brazil at the time and when he delivered the car on September 24. At the time he told her that all the documents had not been signed and he had her forge my name to the PNS, and two other documents. Also, he had her sign a car stating that the car had 8 miles on the odometer when it actually had 70 miles on it. My wife was unable to travel the next morning. When I called my wife later to ask about the car she told me that she was not feeling well and had not really looked at the car yet, she just looked inside for a minute. I asked her if she had been shown the features and she said no. I asked her to read the features off the sticker and she said that there was no sticker in the car. The next day I asked her if she had been able to use the GPS and she said that she could not figure it out, and that she needed me to show her. Also she was not feeling well and she would wait until I get home.

On Friday October 5 at night Cleiton called me and asked if Carla was enjoying the car and I said yes but she had not figured out how to use the GPS yet, at that time he said he didnt think that he had delivered a car with GPS but he was not sure, he sells a lot of cars. When I arrived in the morning I looked at the car and it did not have the features that I had agreed upon at the time. At that time I went to the dealership and spoke with the manager and Cleiton and the manager told me that he would get back to me on Monday with an offer to fix the situation.

On Monday the manager told me the car could be taken back and I could get the same car with the GPS for 180 dollars a month more, a total of $750 a month for a car that only costs $460 with GPS. This is much more than reasonable for a feature, which only costs 4000. He also said that he remembered my conversation with Cleiton and that I said I did not want NAV, which I thought was odd since he did not speak Portuguese, and also he was not present until the end of the transaction. After much discussion with the manager he told me, You get the car you sign, not the one that is described to you.

At that time I contacted a lawyer and he sent a 93A letter of refusal of acceptance of the vehicle and he contacted the dealership. They told him that we were basically trying to scam our way into a car that we could not afford and also that he had a work up sheet for a car with NAV that we refused. Neither or these two statements are true. Also on the response letter to the 93A letter that we received from the dealership the general manager there accused my wife of threatening their employee, which is also a lie since my wife has only called Cleiton once, on the Friday evening which we found out that we had been had to tell him to fix the situation.

When we ordered the car, I was clear from the beginning that the car was to come with GPS, and since that was the case, no other quotes were necessary for me. So the fact that they claim that where were two work up sheets for me is ridiculous. Also, it is ridiculous for the manger to say that we could not afford a car with the feature we wanted. First of all, he is not my financial planner, he is a car sales manager, and second, I had no direct dealings with him. The difference per month is not significant; it is only about 50 to 80 dollars more a month. We would not be going through all of this trouble for that small of an amount of money. We have the means to buy this car and the price we were given for the lease of the car does correspond to the value of the car as it was described to us.in fact, that same car is offered for much less at Kelly and everywhere else. The fact is that we were lied to and delivered a car; which did not meet the specification promised.
