Not a good experience, would never do business with this guy again!

On 9/7/07, I purchased 2 atvs under 1 auction through Ebay. The auction description read:

First thing i want to say, this is for pick up only, unless it is paid by bank transfer. Then i will ship it. I am so hip to the fake check scams and they wont fly here. Cash in hand or bank transfer only. Period! I will not waste one second responding to your emails. Period!

As you can see this is a very clean looking and running 2003 Polaris Magnum 330 4x4, This does not have a speedo or an hour meter. This does have a 3500lb Warn winch with H-bar control. The tires are well above average condition. This has electric start and recoil start, Also has on demand 4wd. This auction also includes a 05 Polaris Predator Troy lee Design edition that has a locked up motor. It is in the top end I do know that. Otherwise it looks reral good. I have the pics of it together the only difference is the rear fender got broke in the garage after I took it off.

Both of these Polaris's have titles free and clear. I do not know what is wrong with it other then it is locked up. I sell these for the bank. This auction is one price for both. I will only take a $50.00 deposit via paypal and the balance must be paid in no more the 5 days.

Now for my story:
We both live in Indianapolis, IN, and when trying to make arrangements for pickup up, the Magnum had something wrong with it and wouldn't start. Because we agreed to purchase and because this was the quad we wanted, we agreed to meet him at Polaris dealer with both atvs to complete the transaction. We gave him $3950 cash and $237 check for taxes on 9/14/07. He agreed to pay repairs on Magnum and both atvs were checked into polaris dealer. At that time, he did not provide us with a bill of sale, but basically used that later to hang over our heads. Eventually did provide it though.

Some time later, the Magnum atv was fixed and had a bill of over $700 in repairs. We had to track seller down to get this paid as polaris would not release the atv until it was paid in full. David had to borrow relatives credit card to get this paid as his promise to bring up a check didn't happen. Also found out at the same time that the 2nd atv - Predator did not have a blown engine as he told us, but rather had been submerged under water for a lengthy period of time and would require over $3000 to repair. The dealer said it was not worth fixing.

Then upon further investigation, we discovered that the predator atv delivered was NOT the same atv that was pictured in the ad and dealer confirmed this. This is when it got ugly. I called David and told him that he was not honest with us and we wanted our money back for this part of the deal. He cussed me out and actually threatened me on the phone. Said very fowl things to me. My husband had to take over at this point because I was so angry I couldn't deal with him. My husband spent the next couple of weeks HOUNDING David regarding the Predator refund and he finally met him at his home and collected $1060 cash and the bill of sale for the first atv.

To make matters worse, he now has listed that Predator atv on craigslist.com for $2000 and is lying about what is wrong with it. He knows how much it will cost to fix and that it is virtually not fixable, but he is playing the game again to hopefully take advantage of another poor soul.

This was not a good experience and I would caution anyone trying to do business with him. He lies and rarely comes through on his word. He says he sells this stuff for the bank, but in actuality, he buys it from his local auction and the puts it on the net - misrepresents the items and takes people's money. I ended up giving him a neutral rating on ebay (felt in my heart it was the best I could do) and he called me an evil witch and said no matter what I would never be happy. I am an honest hard-working individual who always keeps my word and I do what I say. I had to threaten to file a law suit or get an attorney to even get movement on this at one point.

I feel fortunate that we did get our money back and the bill of sale but I feel without the several weeks of persistance and my husband's patience it would not have happened. It also helped that we were local and the dealer helped us see through many of his lies — and acted as our backup etc. My husband is a good man and would not let this go until it was right, and I think David knew that — so finally came through just so we would go away. I feel terrible for everyone else that was left without their item or money. Wish I could help them more.
