Valley bmw valley auto world installed faulty radiator into my car and destroyed the engine

While traveling through North Carolina my car blew a radiator hose. (The car did not run hot). When the hose initially blew I immediately pulled over to the shoulder of the road because I thought that it was a flat tire. Upon inspection I discovered that the it was not the tire. I looked under the hood and found that there was steam coming from the hose.

I called triple A and had the car towed into Valley Auto World. When I had the car towed I told the service person to make sure that he check everything on the car. I explained to him that I was traveling alone back to DC and I didn't want to break down again. The car was towed in on Monday they kept the car 5 days (including the day that the car was towed on) changing the hoses, radiator and thermostat.

On Friday 45 minutes before they closed the shop I was told that the car was ready, but the check engine light was on. I told him that their company had possession of my car for 5 days why didn't they check every thing wrong with the car. He said that he didn't know. I picked the car up on Saturday since I was in Columbia, SC.

Upon picking my car up on Saturday I noticed that my car was leaking oil. I spoke with the sales manager and told him that my car was not leaking oil when I brought in there. He said there was nothing that he could do since the repair shop was close and would not reopen until Monday. While driving off the lot I noticed a dragging noise coming from under the car.

I took the car to a repair shop and the technician repair the leak from the oil pan. The dragging noise was the radiator cover which was dragging the ground that the one the techinican from Valley BMW Destroyed. I drove the car back to Columbia, SC. On Sunday when I arrived home here in Maryland I was in line at a fast food restuarant the car ran hot.

I called AAA and had the car towed to my house. On Monday I called the Service Person at Valley Auto World and was told to take the car to the nearest BMW Dealership. I had the car towed. The Service person said that the car overheated because of a faulty radiator had been installed. They replaced the radiator. When I started the car on Tuesday and noticed that it was running rough.

I took the car back into the other dealership. Where they said that engine head needed to be replaced because it had over heated. I immediately called the Service Person at Valley and was told it was not their fault that the radiator was faulty and caused the damage to my car and that the damage could have occured when the hose blew the first time.

I reminded him that on the final invoice they had given me they never indicated any additional damage and I had driven over 600 plus miles. If the engine was damaged I would have been able to drive the vehicle. The invoice that I received from the other dealership states that when they replaced the radiator that they had to re-set all the senors (faults) and note that there was possible engine damage. I explained all that to them and I have made serveral attempts to get them to take responsibilty.

I have written the FTC, BMW, USA, North Carolina State Attorney General and the BBB with out any success. Their response to the Attorney General's office was that "I CAUSED THE CAR TO RUN HOT" and that what caused the damage to the car.

The bottom line is that since my car is 10 years old with 105000 Miles they do not want to spend the money to replace my engine or repair it. They would rather may a redicules statement that I caused damage to my own car. I just had spent over $1200 to fix that I can not drive.
