Fred Loya Makes Claim to be Courteous and Fair: Justice nor Courtesy did I get! Ripoff

I am reporting the Fred Loya agency to the following entities: the Texas Insurance Commission, the BBB, the TX General Attorney, the consumer complaints, and the Hispanic Chamber of Commerce. If I find more people to contact this week, so be it. All of the details of the case are enclosed; this entire packet of documentation will be sent in full to all of the above mentioned entities. I have also enclosed carbon copies of the letters I have written to the above entities.

Rene Sanchez is the first claims adjuster to enter this report. Mr. Sanchez was both rude and condescending to us and our plight. After numerous arguments with Mr. Sanchez, I asked to be transferred to his supervisor. Enter Mr. Jose Trevino, whose hateful and derogatory manner only exacerbated the issues. Once more, I asked for a supervisor, and was passed off to Mr. Robert Jimenez, the mirror counterpart to his discourteous and self-righteous employees.

I will spare you the items of contention, as these are outlined clearly in the enclosed documentation, but I will share the most heinous aspects of how Fred Loya employees treat their clients, or shall I say, victims of their clients.

First of all, I was told to file a claim with my own insurance agency and get them to reimburse me. This type of asinine logic completely befuddles me: why would my insurance agency pay for the negligence of Fred Loya's insured individual? Alfredo Olivarez was not at fault, and his insurance agency is not responsible for making him whole again. That is the responsibility of the Fred Loya insurance agency.

Second of all, I told that I was at fault "being the kind of people" who do not own more than one vehicle for work. The audacity of such a remark goes beyond any degree of acceptable questioning on behalf of the Fred Loya agency. My husband is a 60 year old construction worker, who has been with Holmes Construction for twenty years and earns $10.50 per hour: no health insurance, pension, life insurance, or retirement fund.

We are hard working people who take care of our possessions and do not have a indispensable income with which to pay for the faults of others. We were responsible in this matter: we carried insurance on our vehicle, albeit one, and we did not cause a traffic accident. The client of Fred Loya is at fault, and therefore Fred Loya should step up to their end of the insurance agreement with this client and cover his faults.

We did not ask to be in this situation, nor did we contribute to the occurrence of this situation. We should not have to beg for fair reimbursement.in the Fred Loya advertisements, the message is that courteous and fair service is a trademark of their agency.

Alas, this is not the case. What is even more disturbing about this situation is the fact that the Fred Loya insurance agency purports to be an asset and value to the Hispanic community; in fact, the Hispanic Business magazine recently named his agency as one of the top 50 Hispanic business in the United States. But the actions of his employees prove that the Fred Loya honor code of fairness and justice, not only for the Hispanic community but for people in general, is nothing but a lie.

I suppose the manner in which Fred Loya was able to make the Fortune 500 Top Hispanic Companies list is by not paying claims to people who have the unfortunate luck of dealing with his agency, his employees, his insured clients, and his crass business practices. After learning that other people have reported this agency for unscrupulous business practices, I feel even more indignant about your treatment towards us because it is clear that this agency is involved in unethical business practices on a regular basis.

I am asking for this company to be investigated as to fair business practices and obeying the state mandated guidelines as an insurance carrier. We have to have insurance by law in the sate of Texas, yet Fred Loya Insurance dont have to seem to uphold his end of the law by paying our fair claims. Somewhere down the line this agency must be held accountable for its actions, and I dont mind being the one to do it. I relish the thought of saving someone else in our Hispanic community the misfortune and misery of having to be taken and conned by the Fred Loya agency.

I, as do you, and as will all of the above mentioned agencies, have copies of all of the transactions/bills involved. Do what is right; honor the bill and pay what is owed.
