On June 7th of 2005 my bankruptcy went thru. I did not receive a bill for my truck payment and called them. They said that they couldn't bill me because of the bankruptcy, it was illegal, considered harrasment. I made a phone payment and sent them a notorized letter to restart my billing. Fast forward to Jan. I again did not receive bill. Called them and they told me that because I filled bankrupcy they could not bill me unless I sent a letter. Sent a 2nd letter requesting they send me my bill. Finnally got the bill but they added late charges and refused to take them off. Fast forward to Nov again no bill. Called them and they said can't send me a bill unless I write letter to them, also I was racking up late charges again. Here is a copy of the 3rd letter I sent them requesting that they reinstate my monthly bill.
To Whom It May Concern:
Can you explain how it is that my bankruptcy went thru on June 7th and then in November you tell me I have to send a letter in order to get my payment coupons.
This tells me that either you guys went a head and kept sending me a bill for 16 months even when you were not supposed (meaning you were illegaly billing me and I could in theory sue you for harassment or. I had already sent you the letter requesting that you send me my bill. Just so you know, I have already sent the the billing request. Twice. This makes the third time. Hopefully you guys are not so inept that you lose this one also. Maybe I should just print a few hundred copies and mail you one a day. That way there will be no confusion as to whether you can bill me or not.
I have also sent a copy of my bankruptcy discharge letter. Maybe somebody there has enough brains to look at the dates and wonder... Gee why did we wait so long to stop sending a bill. MMMMH could it be that we made a mistake and this person has already sent a letter to resume billing?
If you are unable to understand this and need me to dumb it down a little more feel free to give me a call and I will explain it to my neighbors five year old and maybe he can explain it to you guys in terms that you guys can understand.
They never missed another bill but I still had the freaking late payment fees.!
