Ripoff Deceptive Fraudulent Sales Consignment Contract

I had my car being sold on consignment by i-5 motors in fife. When i went to 1-5 motors, i spoke to patrick, the sales rep. He was the one that handled all my paper work. Ethan was the manager and the only thing he did was test drive the car to make sure it was in good condition. When speaking to both of them they told me that they wouldn't have a problem selling my 2003 bmw m3 fully loaded racing model because many people were looking for it because they just didn't have one in inventory to sell. I asked them about how much their comission was for selling the car. They said that it was $2,000 for the state of washington. Then the rest of the proceeds from the sale were mine and would be wired to me. I told them that it would be great.

They did say that they can only have it for a maximum of 45 days. I asked them what would happen if they couldn't sell it and they said it wouldn't be a problem because they know they can sell it. When i got done speaking to them i filled out my information and patrick said for some reason if they couldn't sell the car that i would have to go and pick it up. I explained to them that i was deploying to germany in 3 days, and later afghanistan and wouldn't be able to come back. He said that's fine but the most they can give me for the car was $28,000 if they somehow couldn't sell it, so they made me place $28,000 in the column for the sake of the paperwork and they kept reassuring me they would get anywhere from $33,000-$40,000 for my car. Then again he assured me that it wouldn't come down to that because there were many buyers looking for that particular car and it would be a quick sale, and that's exactly what they did, the car was paid off immediately with my finance company and they sold the car in as little as week for $39,000; their commission would be $2000 and the proceeds were mine for which they lied and refused to divulge to me what the car sold for. I-5 motors received $487.00 back from the finance company and they kept that money for two months and my father fought them to give me that money, but again, they refused to divulge what they sold my car for, so i filed a fraud complaint with the state of washington and they investigated when and how much the car sold for, it was $39,000. I-5 motors owes me $9000 and refusing to give me that money because they said i was stupid enough to sign over my car for $28,000. The sales rep. Was consequently fired for fraudulent practices.

About three weeks later i tried to contact patrick but the secretary told me that he no longer worked there and was fired for inappropriate actions. Then i asked for ethan but he was gone in the mornings and could only be reached in the afternoons. I finally got a hold of him and he said everything is great, the car immediately sold and i would receive my money at the end of the week, but he avoided telling me what the car sold for or how much money would be sent to me. The end of the week came and no money was deposited in my bank account. I called back and he said it should be in there but he asked for my account and routing number just in case if they lost it. He said he would personally take care of it for me. Then about a week after that there was still nothing deposited in my bank. It was getting harder to call because i was more and more busy with my duties as a soldier and i asked my dad to call because they were avoiding me and refusing to answer my calls.

My dad called and they mistreated him refusing to tell him how much they sold my car for. They told my dad that it was my tough luck that i signed over my car to them giving them my vehicle for $28,000 when in fact i would never do that. My dad mentioned to them they were defrauding me, ethan said it was my problem, they have a signed contract and that i was going to get nothing. Period!!!

This is my true account of the process and involvement with i-5 motors.
