Well here we are again with the never-ending saga of Earnhardt Ford, readers not Earnhardt Dodge.

IN a telephone conversation with Scott Clark the manager on 0/06/06 I was asked when would I be in to return the 2005 Sante Fe that I was in the process of purchasing from Earnhardt Ford d/t the bank not approving the financing. I informed Mr. Clark that I would be in sometime before closing. I also discussed with Mr. Clark that if this vehicle was returned d/t the bank not financing the vehicle that I would like a signed affavidavit stating that the vehicle was being returned d/t the deal was rescinded or void d/t financing. I also told him if that is the case my monies need to be returned to my by either cashiers check or money order or cash. I also informed him that our conversation was being recorded. He stated that all would take place when the vehicle was returned.

On 9/7/06 I traveled to Earnhardt Ford in tempe in the 2005 Sante Fe. I then met with Eddie Travis who seemed very nice at first. He sits at the table with me to ask how he could be of assistance, I got straight to the point and told him that I was there to return the vehicle as stated in the conversation with Scott Clark on yesterday evening. He told me to hold on while he gets my file. He then walks to an office and pulls up the file on the computer, he then makes a phone call.

Ten minutes later he comes out to me and says lets take a look at the mileage on the vehicle. We walk outside and he walks around the vehicle as he asks me " why are you returning it?"

I stated " Bank would not finance it." He States " I hate banks." Then he gets in the vehicle and asks for the keys stating that he needed to see the mileage. (Not true you are able to see the mileage without starting the car) I told him that I would hold on to the keys and start the car for him which I did. He then became annoyed and told me that I needed to give him the keys, I also became annoyed and told him that I needed my money and the signed affividavit. He then stated that I would not be getting my money back for 20 days. I then told him that was a lie I told him that since he was the manager he could go in and write a check from their account to me right then and there. He stated it was not going to happen. I told him no money, no vehicle until this matter was resolved. He then told me that if I didn't return the keys he would call the police.

People do not be fooled by this empty threat, if they have taken your money and will not refund it barring any damage to the vehicle which there was none and excessive mileage again there was none and cost incurred in the company repossessing the vehicle which did not take place the car still legally belongs to you and they can not legal hold it and your money, they have to return one or the other.

I encourage him to call the cops so that they can also be informed that you are illegally holding my property. He then told me that if I took off with the vehicle he would report it stolen, another empty threat, I told him to go ahead because I have all the paperwork that states otherwise. Eddie Travis then walked away and went inside the building, I then walked to the driver side of the vehicle so that I could get a signal to call my attorney. I could not get a signal at that time so I called the police to be informed that there was nothing that either party could do it was now a civil matter. While I was still talking to the dispatcher Eddie Travis then drove a vehicle directly behind the vehicle that I had returned to block me from moving it. He then walked back toward the building. I then walked to a sidewalk to try and get a better signal and I tried again to reach my attorney as I was doing so I saw Eddie Travis coming toward me in a menacing manner asking me what was I going to do, and as I turned to walk away from him my foot slipped off the curb of the sidewalk I was standing on and my ankle twisted in an arkward position. Eddie Travis stood there looking at me. I told him there was nothing to talk about if he was not going to return my money and I would not return the keys to the vehicle. He then sneered and said go ahead take the keys we can get new ones and you still won't get your money. I told him that my attorney and the attorney general will see that I do. He then told me that "we have high priced lawyers, let's see who will win." " SO bye and have a nice day."

What eddie did not think that I knew is that the keys have a special chip in it that sends a code to the vehicle to unlock the doors this chip also sends a message to the vehicle when I stick it in the ignition to unlock the steering column as well as disarm the alarm. So it was going to cost and arm and leg to get a key made. But I am sure they can afford it with all the high priced lawyers.

I then told him to have an even better tomorrow because I am sure the next few hours as well as the next few business days wasn't going to be good for him. I then walked across the street to a law office and disappered behind the buildings with them across the street looking on pensively. I was then able to get reception and immediately contacted my attorney. That same evening I filed a complaint with the Attorney General, as well as the better business bureau.
