Like others on this website we have had quite an ordeal with WFS Financial. We had a series of unforeseen events happen wherin our Budget Rental truck was stolen on 8/27/05 from Motel 6 in Mesa AZ and have been trying to get that resolved with Insurance.

We informed WFS of our situation and that upon recovery from insurance we would pay off the truck. We communicated with Bill in accts@WFS our situation. 9/30 was my last payment to WFS Financial. We continued to receive their invoice indicating what we were behind and I again spoke to Bill in November and December informing him that we should receive payment from State Farm in January. Bill informed me that he forwarded it to Paul in Collections at WFS in December.

I then contacted Paul in December and informed him that I want to pay it off in full and am waiting on a settlement from state farm. State Farm was dragging their heels always wanting something else in support of our claim, which I know they have to do their part but I beged and pleaded with them to hurry so I could pay this truck off. We were basically homeless for awhile living in our other truck with 2 medium sized dogs. We had relocated to Prescott in October so each time we dealt with insurance had to travel to the valley. It was hard for us to deal with everything being stolen and other situations we were dealing with and at times just could not deal with all of the issues we have been faced with including WFS Finacial deceptive practices, which is why this whole matter has taken so long.

I Continue to beg and plead with State Farm to hurry with our claim as we were about to lose our truck. 1/24/06 WFS Financial takes my name off of the truck with Motor Vehicle. Begging and pleading again with State Farm I finally was able to get an advance on 1/30/06 from state farm of $10,000 to pay the truck off. Paul@WFS became very beligerent screaming at me and yelling at me that it was too late and that the truck has already been taken out of my name and had already been repoed.

I contacted Certified Transmission and they tell me they have not picked it up yet. I call Paul and get his supervisor who explains that after so many days they had a right to repo it but I would be given one last chance to pay off the truck and to call in two weeks.

Paul@WFS lied and said it had already been repoed on 1/30. My truck didn't get repoed until 2/15 by Allied Recovery at the certified transmission shop in Prescott who supposedly put a new transmission in it. I never received any letters from them indicating they were repoing.

The leter I got was sent from WFS Financial on 2/23/06 certified of their notice of intention to dispose of motor vehicle which gave me until 3/5/06 to wire transfer $9189.02.

We did so on 3/3/06, on 3/8 we picked up truck from Greater Auto Auction Phoenix and our truck had been stripped. We were missing our spare tire, complete tow package, jack, 5th wheel hitch, tool set that was under our back seat, Chrome roll bars, chrome step up bars the tires look like they were switched out and Greater Phoenix said it was Allied Recovery responsibilities to take any personal belongings out and that if there was anything missing to contact them, Allied Recovery said they do not recall any of those parts, Certified Transmission does not recall those parts, WFS claims it is our responsibility to contact our insurance co. For the loss when I think it was in their care custody and control and those parts are their responsibility.

Also regarding title I called them everyday regarding the title as it was my understanding that since it is to go to auction they are to have the title ready and waiting. Tonya @WFS in recovery whom we wire tranferred our monies too finally told us it was not to be mailed until 4/7 which is the date on the envelope.

I spoke to a police officer who informed me there was nothing I could do I had to wait and that WFS was a rather large and reputable company. It took them 1 month and 4 days to get me the title.in March we kept calling different people at WFS to obtain a fax indicating I paid it off because I started becoming nervous about the wire transfer and fraud on WFS part. WFS refused but said they would mail me one. Once we got the title Motor vehicle told me they sent me a fraudulent title and to contact OIG to investigate it.

Now i am about to have a breakdown because of these issues dealing with insurance, and finding out my mom in Nebraska was very ill. We go to Nebraska to deal with my mom and get a call from my brother in law indicating that someone was at their house indicating they were there to pick the truck up due to a federal issue. This guy indicates he is presently on the phone with the police regarding the issue. My family in turn called the police who showed up and informed our family that this guy was a recovery guy and had no rights to enter or repo my truck from their property.

My truck sits in front of their truck and is within a locked gate. The police also informed us that the repo guy called after they were dispatced to my family's house trying to cover up the fact that they had previously lied about having them on the phone. They tried to repo it again and informed our family they were a detective assigned to handle this matter from their fraud dept. When I checked his information it was all lies. Both of these attempts were captured on survellance at our family's house as backup. WFS has made special deals with the dealerships regarding vehicles they repo. We finally got back from Nebraska to deal with this and contacted WFS who informed me they would overnight a release on 6/30/06 and as of today 7/8 we still have not received anything from them.

In my research they had 15 days to get me a title or subject to a $600 fine. I am just beginning this pursuit of injustice by WFS and would like to be compensated for the mental anguish they have caused us as well as for WFS to compensate me for stripped parts, or take the truck back and give me my money back.

Lastly, I would like to mention that it was a little strange that we found a receipt from the Dollor Store in the truck dated 2/14 a day before it was repoed. The receipt was for a for sale sign??? We also have yet to confirm if the rebuilt transmission actually was done by Certified Transmission or how the truck runs as we have been unable to drive it due to the title issue. We can't even get a temporary as Motor vehicle said my name is in no way associated with it due to them taking it off on 1/24/06. I will file a complaint with OIG on Monday and see what can be done but don't know my rights and can't afford an attorney.
