I purchased a 2004 Nissan Altima on April 29 trading in a 2002 Roush mustang. When I financed the Nissan, I was upside down on the financing and was told by Anthony, the finance person that I had to purchase a Security Plus and Maintenance Plus agreements (extended warranties).

I never keep a car very long, usually 18-24 months, so on May 25 I called the dealership and was told to send them a letter stating my wishes. I sent a certified letter to cancel the extended warranties asking that my loan be credited for the purchase amount of the warranties. According to Nissan policy, if the warranty is cancelled within 30 days, the loan is credited the purchase amount, less $35.00 processing fee. Nothing was ever done to cancel the policy nor was my account ever credited.

I traded the Nissan in on July 1 and on August 1, I again called North Texas Nissan to attempt to get my refund. I was told to come to the dealership and bring the proof that I had traded in the car. I on that day took everything to North Texas Nissan and was told I would receive a refund in 4-6 weeks. The end of August I called Sean Hodges at the dealership, told him that I was moving to Alabama and he told me the refund would take 12 weeks. I followed up several times with Amanda Burkhart at the dealership, but was getting nowhere.

On November 2 I initially phoned the Nissan corporate offices in California and called them almost daily until on November 20 I received a prorated refund to July 1. Corporate told me that the dealership would be responsible for the remainder. I spoke again to Sean Hodges and he told me that all I was getting was what Nissan had refunded. He said that he did not accept letters and he would only cancel a policy when someone came to the dealership in person.

I have spoken with either Sean or Amanda at North Texas Nissan at least a dozen times and I was never told this. Sean has been very hostile when I have spoken with him and this is a ripoff. I told him that if I had ever planned to do business with Nissan again, that my experience of having to deal with him changed my mind.

This type of action is a scam and ripoff and should not be tolerated by hard working individuals.
