Brad Powell, a salesman at Mitchell buick sold me a used 1997 dodge ram quad cab 2500 4X4. He constantly reassured me that the truck was in excellent condition, with no problems. I purchased an extended warranty service contract with the truck... The only way I would buy it.
I asked many questions, specifically " how's the transmission"?"was it ever towed with"?"Was the oils and fliuds changed"? He told me there were "several" new parts that cost the dealership well over 3,000... They are ALL used!
Took it to my mechanic in the next town, unfortunatly AFTER I had purchased it (stupid on my part I know) but I have terrible credit and felt this was my only option, that if they could get me financed.
At Any rate, he told me to wait at least a month before I have anything fixed, he said "if it's not broken don't try to go out and get things fixed... You're only going to wind up with more problems" Needless to say, I told him about the leaking oil, that I didn't see or notice when purchased. They want me to bring it into them so they can fix it and then I have to pay more money.
Long story short, he sold me an invalid contract. Found out it WAS in fact plowed with, witch automatically voids out the service warranty. He has told me that " you bought it AS-IS" I said, no I didn't, I purchased a warranty. He continuse to proclaim, "I signed the papers, and I knew what I was buying"
I asked him, if I could cancel my voided contract and that I wanted at least 2,000 off the financed price or he can take back the truck. He told me that "you're NOT getting any money from us, and we will NOT take back the truck"
So then I told him, that I would be incontact with them, along with the State police.
I guess I'll have to go from there, I don't have the funds to hire an attorney and take him to court.
I just Spent 2,610 for my down payment, the service contract, and paid my first 2 payments (and my first payment isn't even due until April 15th)
I am lost, pissed, and feel so betrayed.
It's people like me who get taken advantage over every day by dealerships "doing us a favor" because we don't have Triple A credit.
It's BS, if you ask me, and unfair business.
Just because someone has had credit problems in the past doens't automatically make them a dead beat.
I needed a good dependable truck, for my children and work, and I got a rust bucket!!!
ANYONE have any good suggestions or advise?
Or legal counsel that'll do pro bono work?
