On June 9th I purchased a vehicle from this dealership. As part of the sales contract I traded a 2004 Ford F150 that was leased through Ford Credit. There was a payoff (which the dealer obtained) of approximately $19,000. All contracts were signed, I took possession of my new vehicle and gave them the trade (as agreed in the contract).
On 25 July I received a call from Ford Credit advising me that the payment on the 2004 Ford F150 (which I traded) was past due. I advised Ford Credit that I had traded the vehicle in over a month earlier however, they stated that they had not received a payoff on this vehicle. I faxed them all of the contract information indicating the trade however they continue to call me on a daily basis.
I have attempted to resolve this through the dealership (I have spoken with the General Sales Manager known to me as Perry) and he simply advises me that he is taking care of the problem. Because of this, Ford Credit has placed a "30 day late" on my credit report which, if the problem is not rectified soon, will be a "60 day late".in addition, the trade was offered for sale at Aloha Kia almost immediately after they received it from me. It had been advertised online up until the middle of July. It has since been removed I assume this is because they sold it.
As they have not yet paid it off there is no way that they can have the title for the vehicle therefore, in addition to the above, they are selling a vehicle that they do not own. The person who purchased that vehicle is also a victim of their deceptive business practices as they cannot re-register the vehicle until the bank receives documentation of clear title.
Shortly after the transaction I moved to PA so it is currently impossible for me to actually go to the dealership. The only contact I have had with them has been by phone. I wonder how many other consumers thay have done this too...
I intend on following this through to the end. I refuse to be a victim to this business. If there is anybody else that has had a similar experience or any attorney's that may be interested in pursuing legal action against this company please contact me.
