On 11/19/04, I took my 1997 BMW 74iL to Passport BMW in Marlow Heights, MD to have repair work done. The repairs were to my dash lights (electrical) and my left rear wheel control arm. Both repairs are explicity listed in the only warranty faxed to me on 01/29/03 by Ms. Regina Reynolds Of Atlanta Auto Assistance. Ms. Reynolds is the agent from whom I purchased my Next Car Warranty contract.

Also, the warranty information faxed to me is identical to the warranty information shown on Next Car Warranty's website. It clearly states under "Front and Rear Suspension System: Control arm shafts and bush king pins and bushings, Lower and Upper ball joints and control arm stablizer bar, spindle and spindle supports, and torsion bar".

However, when the Passport BMW mechanic contacted Next Car Warranty for authorization for repair and payment for repairs under warranty, the agent from Heritage Administration Services, Inc (Rex) informed the mechanic that they would only authorize payment for the in dash electrical work. The warranty coverage for the control arm was denied because "it's not covered because of wear and tear". I have tried in vain to contact Ms. Reynolds, Next Car Warranty rep via e-mail Heritage Administration Services, Inc.

To date, I have received only a more "detailed warranty" statement with "wear and tear" highlighted. The out of pocket cost, which was also the first time I had to pay first and be reimbursed for services, I am attempting to recover is $414.54. I would like to ad that this is the first adverse issue I have had with this company.

It could very well be the way in which the Heritage rep interpreted the policy; "wear and tear" is just not a valid response to what is clearly covered under my warranty "OPH-001959. Therefore, I'm requesting your assistance in recovering my out of pocket cost.
