My mortgage loan was originally with UC Lending corp then wad purchased by EMC Mortgage co which has been a nightmare for us. The property taxes weren't paid from escrow as stated they would be and It took several calls to their office to attempt to get the taxes paid.
This was only the beginning as The real problems started in 1999 due to loss of employment payments were behind and EMC didn't want to work with us or respond to many requests by certified mail and also E mail to attempt to work out repayment. The amount owed was constantly changing and rude calls were coming every few days. Finally Chapter 13 was filed and the plan was confirmed and discharged. Immediately after the dankruptcy was discharged we recieved notice that EMC was going to foreclose on our home. EMC stated we were 3 months behind when we completed the chapter 13 plan.
Our lawyer never staqted that any other pmts were to be made except to the court and upon completion the loan was to be current. We called EMC again with no success in being able to get a payoff amt from the EMC office and also called EMC lawyer, Mr. Sterns office with no reply also sent several emails and more certified mail. Here it is again in June refiling chapter 13 refusing to give up our home to EMC and be another victim. Thus far they have added over 20,000.00 in fees on to the loan and dropped theInsurance homeowners policy we've had for 15 years without renewing it and placed a forced policy for only my homes value and not any contents or liability coverage with an Insurance co they chose.
Then September we were hit with Hurricane Frances and again by hurricane Jeanne. Our home received wind and water damages to roof, window, door and storage bldg roof collapsed. The insurance inspector for Assurant group came to inspect and stated we'd recieve a letter in 10 days stating what they would pay on the loss.in October, We recieved letter stating the check was mailed to EMC Mortgage company and are waiting for Their reply to send the funds to repair our home. The chapter 13 trustee wont tell us anything and EMC has not sent the insurance funds and our home is waiting to be reapired as we havent the extra funds to fix the damages.
We are current in making pmts to court and have lawyer waiting on a response as usual from EMC. We will continue to fight to save our home. EMC should not be allowed to conduct business in such a manner where they prey on people with problems.
