We are in chapter 13 with six months payments in post arrears under a court order stating that they are to be paid out over the remainder of the chapter 13. Vanderbilt applied our payments made after the court order to the arrears and are now stating we are six months behind. I have contacted our chapter 13 lawyer
and saw him for about 10 minutes enough to show him where the six payments we were supposed to be behind were and why we were six months behind.
He was supposed to call them. I have talked to three different people at Vanderbilt and each is a little more rude and stubborn than the previous one. We recieved a 30 day notice wanting 3,020.00 in 30 days or their going to repo. This is crazy. I'm supposed to see our lawyer tommorrow if he can sqeeze me in, as he was busy for a month filing new chapter 13s before the law changed. How can they violate a court order like that. We have a year left in the 13, and I guess what was suppose to save our home will lose our home. Thanks
