In 1997 I lost a job of 11 years due to down sizing.in order to keep from losing our home, my husband and I filed Chapter 13. During the time we were in wage earner, our mortgage company sold our loan to Litton Loan Service out of Houston, Texas.

After 3 years, we were able to have our wage earner discharged. We were told by the Chapter 13 trustee that our mortgage was current, and they would contact the mortgage company about the discharge.

We began paying our mortage payment as usual, but within 2 months, we got a letter from Litton stating we were 6 months behind and they were going to start foreclosure unless I paid them $3000.00 and paid 1 1/2 times our mortgage payment each month until we were caught up.

We paid the $3000.00, and began making the payments so we wouldn't lose our home. A few months after we began making the payments, our granddaughter, age 8 months, had to have open heart surgery, and was in the hospital 3 months on life support. I lost time from work, and missed a payment.

Once again they threatened foreclosure, and once again I had to come up with another $2000.00, and start out 1 1/2 payments all over again. What we had already paid wasn't enough I guess.

We did this until the mortgage was paid up current, which was 5 months ago. We are now trying to refinance our home and get out from under Litton, but they are still reporting to the credit bureaus that we are in foreclosure, and that we were behind multiple times over the past year, even though we paid the note every month, without fail. They are saying that they report according to the contractual date, whatever that means.

We want to refinance and get away from them, plus get a better interest rate, but because of their underhanded reporting tactics, no one will work with us. We feel that they just don't want to turn our account loose. Also, after doing some research, I found out that when we were discharged from Chapter 13, Litton added back all the late fees and other fees that they couldn't add when we were under wage earner.
