Hurricane Isabel on 9/18 damaged this 12 story hotel in Petersburg, Va. Claimant filed damages in total of approximately $9.2 million. Selective Insurance approved approximately $420,000 and did not even pay the remaining $35,000. They are claiming fraudulent misrepresentation on the part of claimant and we have been in litigation for seven years. This is a classic case of what an insurance company will resort to in order to avoid a catastrophic claim. The national field adjustor and a vice president of Selective made critical decisions immediately after the hurricane to remove the water extraction and mold remediation company from the premises by refusing to pay them. They subsequently had their SIU fraud department issue a report on the company.
The SIU report exonerated the water extraction company; and the Selective employees conspired to cover up all the facts surrounding the report, including stating that it does not exist.
