Failure to process application caused my student loan default, need legal advice

I have a legitimate student loan account which has been transferred to ECMC. I contacted them about options to avoid default on my student loans and due to my low income level I qualified for a forbearance program. I was instructed by ECMC to fax in my application, wait until they called me with the status of the application, and once I heard back from them to send a "good faith" payment to the original holder of the student loan debt. I faxed my forbearance application to ECMC and I received no failure to send fax report from the fax machine I used. So I can fully believe my fax went through to ECMC. I faxed the exact forms that they emailed me in completion. I was supposed to hear from them right before I left to go out of town for a couple of weeks. My loan would fall into default while I was to be out of town.

I never heard from ECMC over this entire time until recently when they called me asking to speak with me about my account. Upon calling them back they informed me my account has gone into default. Their notes show speaking to me about forbearance but no information about receiving or processing the application I faxed to them. The forbearance program that I qualified for (and is the only thing I can afford) is no longer valid since the account fell into default. Since their records show no application was received (even though my fax machine did complete the fax) means they are unwilling to do anything about addressing their lack of processing my application and their unwillingness to do anything to get the default status of my loan removed.

I did everything I was supposed to do by their instructions except sending a good faith payment (which was to follow their contacting me about the application status). Their inaction to even receive the application I faxed them led to my default, not my lack of action to resolve the issue and avoid default. Do I have ANY legal action I can take. The only paperwork I have for this is only the email they sent me and the attached forbearance application. All other events in this situation have transpired by phone contact.

Any help would be appreciated. When I was informed of the default status, what their records showed, and their inability to do anything about it; I asked to speak to a supervisor.By no surprise none where in their offices and they tried to shovel me off to a voicemail. I refused and as of now I am trying to find out what options I have before I call back and demand to speak to a supervisor in person.
