Ripoff wrongful foreclosure, misapplied payments, lost payments nationwide

Chase mortgage lost five of our payments and refused to credit our account for them even though I sent them copies of the canceled checks by certified mail. This caused us to appear far enough behind in our payments that they began a foreclosure proceeding, charging us tens of thousands of dollars in their legal fees. We were forced to file chapter 13 debt protection in order to save our home. This was bad enough.

Then, once our bankruptcy was payed off and we were back in good standing we got a knock on our door. It was a realtor who offered to help us with our foreclosure! We had no idea what he was talking about! He showed us a public notice stating that our home was indeed being foreclosed upon.

We contacted Chase. The phone recording told us we had to contact their attorney. We did. We were told that we were five payments behind. This was impossible and we had the canceled checks to prove it. The attorney stated that they had a right to foreclose without notifying us because we were still in bankruptcy (which we were not). I told this attorney that number one were no longer in bankruptcy and number two if we had been in chapter 13 they would have to have gone through the bankruptcy court and filed a motion which obviously they couldn't have done because were not in bankruptcy. The attorney was rude and told me that he would have it investigated. Days went by and nothing was resolved.

With a foreclosure looming over us we contacted our local HUD office for help. A Hud officer intervened and with a lot of trouble finally got a hold of someone who dealt with these problems at Chase. It turned out that they misapplied the five payments. They sent an apology along with a request for the five payments to be made by cashier's check, being we were behind on our payments. This was rediculous to us and we refused. We sent them the copies of the canceled checks instead. They accepted this as proof of payment.

However, for weeks after this we recieved notices that our home was still being foreclosed upon. People were coming to our door to check on it's occupancy and others interested in snatching it up were driving by to check it out, some even took pictures. We finally gave up and refinanced to get away from the harassment and threats. We ended up paying 19% interest on a new loan (because of our bankrutcy). We did this because Chase had us so fearful and mentally and emotionally drained.

We contacted the local Attorney General's office and made complaints wherever possible. All we've ever gotten in return was a pathetic and rather arrogant apology for our disatisfying customer service experience. They owe us thousands of dollars in damages not to mention what they put us through. Attorneys are too expensive for us. I hope for a class action lawsuit against them.
