Representative legal counsel for plaintiff, Loma Vista Apartments FAILURE OF CLARK COUNTY COLLECTION SERVICE, LLC TO RESOLVE A FRAUDULENT DEBT ASSIGNED BY LOMA VISTA APARTMENTS

From September until July 31, husband (at that time, fiancee) and I rented apartments, individually, at Loma Vista Apartments, 1200 West Cheyenne Avenue, North Las Vegas NV 89030 (702) 657-6238. As a result of poor, dilapidated and unsafe conditions, five or more management and ownership changes and inability of staff to maintain the property/documentation in a condition condusive to suitable living, high rates of illegal and violent crimes in the apartment complex, we decided it was in our best interest to vacate our two apartments and move in together at another locale.

Upon vacating those two apartments, Loma Vista employee, Aldolfo Reyes performed move-out checks on both premises, signing documentation to confirm (verbally and in writing) that both premises were left in an orderly manner, with no discreancies or problems requiring additional monies for any repairs on either apartment. We properly signed and submitted 'Notice of Intent to Vacate' documentation with Loma Vista Apartments in a timely and appropriate manner for both apartments. No further problems were reported or indicated; we were assured by Mr. Reyes we would receive our security deposits in return for both apartments, as no discrepancies were noted.

My husband and I left the appropriate forwarding address to our next residence. On 02/17, Clark County Collection Service LLC, with representative counsel Edward Lubbers #3476, The Lubbers Law Group, 2500 West Sahara Avenue #206, Las Vegas NV 89102, (702) 257-7575 filed a civil suit in Justice Court Las Vegas Township against me for $161 and against my husband for $1691 for damages (totaling $1852), on behalf of Loma Vista Apartments. Previous to 02/17, we were never informed of any issues or judicial actions regarding vacating these two apartments.

We received and maintain documentation stating there were no discrepancies noted in either apartment, leaving Loma Vista Apartments in good standing. According to a Register of Actions provided by the Clark County Courts, neither my husband nor I were served with a summons and complaint in person, and in fact, we were improperly served with a summons and complaint via post in early March. On March 23, my husband and I filed our response with the Justice Court Las Vegas Township. We were never notified of any further actions until July when my husband and I entered into a debt settlement program to manage a few shortcomings in our financial house. Even though this debt as assigned to us by Clark County Collection Service, LLC has been and remains disputed by us, we had been willing to work through our representative counsel to negotiate this $1852 debt through our debt settlement program, in order to restore our credit and resolve any outstanding debt before my husband, diagnosed with a terminal illness, becomes fully incapacitated or dies.

After multiple attempts (at least four reported attempts) to negotiate this debt with Clark County Collection Service, LLC, this agency has declined and refused all negotiations with our representative counsel and has continued to inflict mental anguish, pain and suffering, continued damages to credit and our well-being through negligence, disregard, improper actions, false, deleterious and improper legal proceedings through misuse of the Clark County courts in an attempt to extort monies from us.in addition, we were willing to comply with any negotiations to render payments, even though this debt is invalid, just to end the chaos created by Loma Vista Apartments and Clark County Collection Service, LLC. Clark County Collection Service LLC refuses to resolve this debt in any way with our counsel. And, Loma Vista Apartments has informed us of their unwillingness to work with us or provide any evidence of damages or documentation of this debt.

As I feel Clark County Collection Service, LLC and Loma Vista Apartments are attempting to extort money from my husband and me, in addition to the judicial improprieties previously perpetrated by this collection agency (ie. Not serving the 'Summons and Complaint' regarding this issue to my husband or me in person and mailing the 'Summons and Complaint' to our address and previous addresses so that the 'Summons and Complaint' was received by my husband and me via post over two years after our move-out.) Clark County Collection Service, LLC is pursuing a fradulent charge as put forth by a reportedly less-than-reputable creditor (Loma Vista Apartments.)
