I am a victim of abuse and mental anguish from Centex Home Equity. We took out our loan to build a barn for our horses. Due to ground leveling and equipment, the barn cost several thousand more dollars than was expected. We had to pay the barn builder so we got behind in all our payments, including our home mortgage.
I understand these people want their money. I did sign a loan agreement to repay them. They have every right to expect payment from me.
My problem began when I tried to make payment arrangements with them. I've always been told it is better to call and try to work something out than ignore the creditor. So this is what I did.
I set up bank drafts with them. I was expecting a 401K check. I found out it was going to take a little longer to get my 401K check. I called to see if I could change the bank draft dates. The lady told me yes, but the drafts were already in the system and she could not just change the dates. She instructed me to stop payment on the drafts and she would reissue them on the dates I wanted. I did as she instructed.
Then I started receiving phone calls telling me my checks were returned and I would have to send money orders for them. I explained that the lady I spoke with instructed me to do this and she reissued drafts on other dates.
I was told by the manager that no one there would tell me to do such a thing. That was not the way they worked. I assured him it was the truth.
He finally agreed to take the block off my account so the check drafts could go thru. Then I set up a payment for the next month. He pressured me to make two drafts that month. I told him I would make the one and if I could, I would call back to make another at the end of the month. He finally agreed. I even repeated my statement before I got off the phone. I said, "Now we have the one set up for the 14th and I will call back to set up the other one.", He said, "yes".
Now at the end of May, without my call or approval, he ran the second check thru that I had not authorized. He used my next check number. It was returned NSF. When I called and told them I had not authorized that payment and I wanted my $25.00 return check fee reimbursed, they agreed. I have yet to see it.
At that time, I also told them I would like to make arrangements for two payments for June. They scheduled one for the 18th and 30th. Then a few days later they call and tell me I have an NSF check that has to be paid for. I explained again that it was not my fault. They ran that check thru at the end of May without my consent. I finally spoke with the manager again and he got very rude with me. I told him it was not fair that they had put a block on my account where I can no longer send them checks when it was their mistakes.
He told me he set up the May payments himself and the 30th one was NSF. He said I can pull the taped conversation. I asked him to do so. I said pull the tapes from our conversations. He said, "I can pull tapes all day, you are playing games with me." I said "I am not, pull those tapes and you will see what was said." He then said, "Are you calling me a liar?", I said, "No, but I am not lying." He said he had no notes about me making arrangements for June 18th and 30th. He said they couldn't do check drafts anyway.
I then told him I would send him two payments tomorrow by moneygram and I wanted to speak with his supervisor. He said he was the supervisor. I told him I was sure there was someone else above him. He got very hateful and said you have till noon tomorrow. I told him he would have his money by noon tomorrow but I want to speak with someone else. Several times he stated he was the supervisor and there was no one else to speak with.
Naturally, he finally said I could call back and ask for this extension for the V.P. Of course, the VP did not answer and I all got was voice mail and he has not returned my call.By the time I was done, I was in tears for what this man had insinuated about me.
I feel these people have defamed me and tormented me by continuing to call after I make arrangements with them. Or I return their calls and explain the situation only to get called five minutes later by someone else from the company. Then they call everyday and I go thru the whole explanation again. Do these people know how to communicate to each other?
They are the ones who make the arrangements then call and say they can't do that or there was no note on my account regarding these arrangements.insinuated I was a liar. Said I was playing games with them, when all I was trying to do was make arrangements and not leave them hanging.
Like I said, they have every right to want and expect their money. I do not have a problem with that. But I would like to know if these conversations were taped. I think if they pulled them they would have some ex employees.in the meantime, I am being punished for their mistakes. I can no longer write them checks. I have to go get money orders or do moneygrams which is an inconvenience to me.
