Federal Bank FSB ripoff These people are ruthless crooks and they need to pay for all the wrong doing they have brought to homeowners that have ever dealt with them

Where do we begin? In 2000 Ocwen Federal took over our mortgage which was with New Century. We received a letter in the mail informing us that our new mortgage company would be Ocwen Federal. Since then we have had nothing but a nightmare with this company. We have fought tooth and nail to keep our home. Ocwen put us in a "Forebearance Plan" and it was something that we were just barely able to pay. During the "Forebearance Plan" I, Lori Vann, lost my job. We were living on one income and it was becoming next to impossible to make ends met.

My husband contacted one of the lawyers at Moss Codillis and told them of the situation. These folks did not care to hear any of this and was in no way willing to work with us. We continued to make payments and was one payment behind because of the fact that I lost my job. Might I say that at this point the only way that we could make payments was by Western Union. We receive a phone call one night and it was a lawyer for Moss Codillis informing us that the last payment they received from us would have to be returned because we had gotten behind on a payment and the forebearance plan did not allow you to get a payment behind.

They further stated that I would have to go to the nearest Western Union and ask how to go about getting that money returned to us. They then proceed to tell us that unless we came up with 3 payments of $864.00 and attorney fees which came to a total of $2,991.00 that they would have to start the forclosure process. They did not care that only one family member was working and we were struggling to make payments.

Needless to say on October Ocwen Federal forced us to have to file bankruptcy (Chapter 13). The bankruptcy picked up the arrearage amount which we reported as $3,000.00. When Ocwen reported the amount to Chapter 13 it was for $7,796.00. We have requested the breakdown for the amount and was given some bogus figures that my husband and I know are incorrect. The bankrupty attorney informed us that he did not know if we would ever be able to get this correct because it was hard to get answers from them and it was also hard to follow a correct paper trail.

We are in the process of trying to refinance our home and when the company that we are dealing with contact Ocwen to see how much the payoff was they were told a figure of almost $65,000.00 and that this cost covered arrearage and attorney fees. However, the new mortgage company, will be paying off the balance of the bankrupcty as well which includes those arrearage. Our payoff amount should be around $56,000.00.

Since we have been with Ocwen they have never given us a coupon book, a forebearance plan, nor a correct payoff amount. The bankrupty attorney, the new mortgage company, and my husband all have different payoff amounts from Ocwen which they all called within the same week to get this information. The only paperwork we ever receive from Ocwen is a statement of past due payments and that as well is incorrect.

Our bankruptcy attorney receive a letter from Moss Codillis asking that they be released from their obligation of use making our monthly house payment to them because we were # payments behind. I had to contact our bank and get copies of all cancelled check dating back from October. There was one check that had never cleared the bank and that was in December. I mail out the house payment check on the 1st of each month the same time I mail out the payment to our bankruptcy trustee. It takes Ocwen between 15 - 20 days for a check to clear the bank and then they fault that on us. They have now told the bankruptcy attorney there is only one payment missing and we would have to pay an additional $124.00 per month to make it current.

We are in the process of re-financing our home as we mentioned earlier and it appears that Ocwen is going to come out like a fat rat. They say the pay off is $65,000.00 and that includes arrearage which is also included in the payoff amount for the bankruptcy. So when the new mortgage company pays both these payments off, then Ocwen will receive arrearage payment twice. And that doesn't count all the other cost they have falsely charged us for.

Why is a company like this still allowed to operate and illegally rob people? When will justice be granted upon everyone that has dealt with Ocwen Federal. How do we go about getting our name in with the Class Action Lawsuit againts Ocwen? Does anyone know how we would go about obtaining a lawyer or what type of lawyer we would need to take these folks to court and bring them down. Enough is enough. My husband and I have lost countless nights over Ocwen an debating whether we shoudl just let them take our house. But we will not give up without a fight first. These people are ruthless crooks and they need to pay for all the wrong doing they have brought to homeowners that have ever dealt with them.
