No Answer After Mediation on Cash Offer for Sinkhole Home

After reading the many reports against CitiMortgage on this site and elsewhere, I had to voice my opinion.

I have been fighting to keep my home for 3 years, going on 4. I have been lied to (temporary modification) and given the runaround and numerous different answers. These are the same complaints that most of the reports here and elsewhere are voicing.

On November 2, after I requested a mediation with CitiMortgage's attorney, one was granted.

I met with my attorney, a mediator and the attorney representing Citi, who, once seated, dialed someone with CitiMortgage who needed to be in on the mediation. This person was allegedly located in MO. Once the initial reason for being there was expressed, we were to split into separate rooms for mediation, as is customary. The attorney for Citi stated she did not want to split into separate rooms, as she might not be able to get someone on the phone again if she hung up. What? This is their attorney, and the attorney cannot even be sure of getting someone she represents on the phone?

We did split into separate rooms, with their attorney staying in the room with the precious connection to the Almighty CitiMortgage. The offer I made was straightforward, with no negotiating. It was a cash offer for the house (which has an unremediated sinkhole) in exchange for the deed, the dismissal of the lis pendens and no deficiency judgment being placed against me.

CitiMortgage's "ghost" person on the phone stated that they were unaware there was a sinkhole on the property since I did not escrow insurance with them, and that they would have to investigate the claim. (They would have known if they had listened to me when I reported it to them.) My attorney immediately sent them the claim I made to my insurance company and the engineer's report, which is public record. We were advised they would get back to us within 10 days with an answer.

That was Nov. 2, as stated above. It is now Dec. 31st and still no answer.

My attorney has attempted on 3 different occasions to get answers from Citi's attorney. She said she did not know and told him to call them. I called them, and not only did they tell me they could not talk to me until they were authorized to do so, they could not tell me who I could call that could talk to me or my attorney.

Again, more lies. Who else in this country has the right to do whatever they feel, when they feel and how much they feel in court proceedings and it still be legal? Why do we take this kind of treatment when it's our tax dollars keeping them in business in the first place?

To all those folks who say those of us in trouble are freeloaders attempting to get something for nothing, I say wake up! God help you if you ever fall on hard times! Even if your home is not in foreclosure and you still have the means to pay for your home, the banks are laughing at us, all of us. They collect the big bonuses while we keep struggling just to understand why and how they get away with all the corruption and fraud they commit on a daily basis.
