Ripoff Owes ME money and refused to refund! After I pursued communication for a year, LIED and DESTROYED DOCUMENTS

I had a FCNB credit card with Newport News. I had a credit due to me of over $300. I was told by Newport News to contact the card processing center in Beaverton, OR.

However, my situation is a little different my most others— FCNB owes me money and refuses to pay it. I literally called and wrote the company in Beaverton, and subsequently, Old Bethpage, NY every month for a year and a half. I followed every direction given to me by the company and people on this website. I sent my letters by certified mail. A "David Norberto" signed for all of them. At one point I received a form letter stating they were looking into my problem— of course, I never heard from them again.

Twice, I spoke to very helpful people (meaning they didn't hang up on me). I was told that I was paid a year ago and they purged my file a few months later. This is a fradulent lie! I told them I never received or cashed any check. Also, no company (especially a credit card company) would destroy documents little than a year old.

Here is what i've learned:

It doesn't matter which division anyone is having problems with— they all fall under the PA office and, ultimately, the NY office.

A friend, who is a lawyer, told me the best action is Small Claims Court. It is very easy to file and doesn't cost much at all for the plaintiff but it does cause a lot of time, energy and money on the part of the defendant.in most cases it is an incentive for companies like FCNB to settle with plaintiffs. We also feel this "Mr. Elster" may be a false name with a false number to redirect persistant complaints.

Most important advice— keep every document (every letter, every bill, document every phone call, get names and phone numbers)
