TD Bank Charges NSF Fees with sufficient funds in the account

TD Bank charged me 42.50 in NSF fees even though my account never went into a negative balance.
They say they have to hold incoming cheques for 5 business days so that they can clear, so they held the cheque for 5 days until it cleared and charged the fee anyway. Their reply was that there would not have been enough funds in the account to clear the outgoing cheque until the deposit had cleared. If they held the incoming cheque until it was verified and they held the outgoing cheque then no funds were actually delivered until the money cleared, so why the NSF fees?
P.S. The transactions were processed from one of my small business accounts to another one of my small business accounts, both are with TD Canada Trust. Neither account has ever been in a negative balance in 6 years since opened. They recommend purchasing overdraft protection, but naturally they charge to have overdraft protection even if you never go into a negative balance. They also recently raised all there banking fees and are one of the highest small business fees out there. I have recently cancelled my car insurance with them because of horrible customer service, I am closing both business accounts and my personal bank account with them as well. I just wonder how many people have been taken advantage of and for how many thousands, hundreds of thousands of dollars or more. I think a class action lawsuit is in order. I am one of the 99%.
