I wound up in this situation due to a divorce. My wife and I married with both of us having custody of two children each. My house was too small so we looked at this triple-wide.in fact I drew floor plan since they didn't have a 5 bedroom at the time evidently. Well after divorce I retained the house (which is not in my name nor is the note in my name).
For the past 3 years I have made the payments and repeatdly asked for them to put everything in my name note & all but of course they would not! The last several times I asked I was told that they were NOT in the lending business. I wish they hadn't been 9 years ago that's for sure!
In the summer of '03 I found myself unemployed for the first time ever. At this point, still with 1 school aged child at home and living entirely off savings & investments I really tried to get them to re-finance. I just wanted to be treated fairly. Well the longer it went on the worst it got as far as harassment and treatment like a bum that I decided it would be a cold day in H—
before I would even try to make pmts. So I sit here tonite after finding this site about 20 minutes ago dumb-founded at all the reports about Green Tree! I would have loved to have found this site long ago! I only read a couple so that I could hurry and write this report as I am being evicted in the A.M.
Yeah, now it's going to get good! A couple of weeks ago I was served a summons to appear in court so G.T. Could get possesion of their property. That's right— my name is nowhere on the house or the loan— so it said for me & John Doe to be in court!
Oh, by the way I failed to mention that on 2 seperate occasions I was called on Wednesday and told that they were picking up house the following Monday so I better be OUT. I recall the first time being around Nov or first of Dec. A couple weeks later the same phone call. So now we are going to court. I know that I really don't have to be there but I'm not going to miss this. Of course the judge doesn't know what has been going on and he just assumes (I guess) that my ex-wife whose name is on everything just decided not to show up. Let me assure you of one thing, HAD SHE KNOWN, she would have been the first one there!
So G.T. Gets their judgement and off we go. The past 2 weeks have been something else. I was told several times to get out by the next day or two cause they are on the way to get house. So about 3 days ago I see my ex-wife and she is lost as to what is going on! She holds a very public position in the health field in this town of approx. 12,000. She doesn't have a clue they are taking the house. They NEVER ask me about her. We don't see each other too often anyway but they told me yesterday that they have tried for 200 days to reach her because they have all her numbers but they can't. Liars. The same afternoon they asked my friend who owns the land if he knows how to reach her and whether or not she stills lives here. Wonder what happened to those numbers they had?
So now they are coming to get the house and they never even bothered to look for the owner! I am under the impression that the judge WILL find this out in the morning and probably won't be real thrilled with the fact. I am not a lawyer but I feel like before you can just take something from someone you have to tell them so they have a chance to go to court and make arrangements. Just another instance of they do what they want when they want and we are just too dumb to know the difference.
So while this is on going they want the land owner to buy the house cause they are going to loose so much money if they have to come get it. And all I've heard is we are coming to get it! As late as yesterday I get a call saying for me to be out by tomorrow so I just asked if they were not going to wait for the counter-offer that was coming from the land owner later in the day and she said she didn't know anything about that. I have heard that from day 1. Nobody knows what's going on but they can ALL call the same day & harass the devil out of you. They are in the same office, they must think everybody is totally stupid!
But I'm sure they do, as one time I was told that if we were worth a damn as people we would not have gotten the loan from them in the first place! This was several months ago and I did see my ex soon after and was informed that the lady where we got the home said we HAD to get the money from them! Sounds like a little payola under the table to me. But that was long ago. I knew I was in trouble when Green Tree went bankrupt, Conseco buys them out, then goes bankrupt, now we are back to Green Tree. Smells fishy to me!
I read with interest for about an hour last night from a law book I believe Sec 1692 from about 1692c with all the sub-para's also all the way to about 1692i and just nodded my head at almost everything written as I had heard everything they are NOT suppose to do and it was all written there!
Now I see very clearly that this is happening all over the U.S. With the same Company. If that doesn't tell everybody how seedy these people are nothing will. It is time that we make our elected officals do some awful hard looking at these Companies. They should be flogged in public then be made to sit and listen to people talking to them like they are nothing. Just like we have put up with since doing business with them. I want to urge everyone to write to all of your Representatives, Senators, Attorneys General and anyone else you can think of to put a stop to people who live to financially rape the public!
I can assure you that all the people in the right places in TN will hear from me tomorrow! I'll quit now before I get mad. I gotta pack anyway.
We have to write or no one will know what they are doing, so WRITE!
