Overdraft charge transaction that wasn't overdrawn Internet

I checked online banking because I noticed I was over drawn and wanted to check into it.
So I looked at my account and see that on the 5th I was charged a overdraft fee. I looked over to see my balance, and I had 85$ left in my account. I couldn't figure out why if I had money in my account I was over drawn. I call them up, and she tells me to go to the Account History tab. So I'm looking at it, and she tells me that I was charged a 35$ overdraft fee because I had some items PROCCESSING on the 5th. I told her that the items didn't go through until the 8th so why was I charged a overdraft fee. She's like "Yes I know what your saying, but do you see account balances, you had xx amount in your account and after the transaction (the one that was posting) went through you were charged a overdraft fee."

I told her that the items were processing and didn't post till the 8th so that 1 transaction didn't bounce and I shouldn't have been charged a overdraft fee. She just kept telling me "yes I know what your saying" and that the money was put on hold for the businesses and that's why I was charged a overdraft fee.

It's BS. I have, unfortunetly, had to overdraw my account a fee times to fill up on gas in between pay days. And have never had this happen.

They even have the items that posted on the 8th in order from highest to lowest. Isn't there a law suit because of them charging overdrafts for doing this? I am so disgusted.
