Now that we have received our notice from the FTC regarding USA vs. Fairbanks Capital and Allana L. Curry, et al. V. Fairbanks Capital Corp. Claims Admin Center, c/o Gilardi $ Co. LLC PO Box 808054, Petaluma, CA 94975-8074 for Late Fees/Default Late fees, I am finally sending my report.
I hesitated to send my report in the past for fear of it being used against me in court. So far I have not hired a big law firm but I have been considering it if the FTC doesn't come through for us.
My claim is that Fairbanks has no record of several of our payments and this trouble begain during the 'handoff' stage when Fairbanks acquired large portfolios of mortgages from other companies. Fairbanks had poor communications with us on their servicing procedures thus thay lost records of our payments.
We are currently trying to refinance and I fear this will not be possible based on what I have read here. I appreciate any information I can get on my options and what our next step should be.
