Complaint / Review
Fairbanks Capital Corp
Ripoff, now stealing homes in connecticut

OK, Here it goes, I was orginally finance with Equi-Credit until Fairbanks took over my loan. I too am now frustrated on a daily bases. I have been fighting with Fairbanks for 2 years and feel it's been a power struggle. Rude customer service, never getting answers on accrued charges. They constantly say to mail a letter to the complaint department and never get a reply. The following months bill is received and more charges are accruing. Couple of months ago we were just told that each time you receive a "ON DEMAND LETTER" in the mail, it costs YOU (the customer) $10.00 for a piece a paper. Each time you answer the the telephone when they call, it costs YOU (the customer) $15.00. Fairbanks insists I had a drive by appraisal done on my home, wants me to pay $250.00 for documents they won't send copies of. Attorney fees for an aledged forclosure back in w hen they first took over my mortgage. (I was never notified of this.)

NOW as of 1/27/04, I have in my hands FORECLOSURE Documents. After the property has been my husbands family since 1800's, had to tear down a house and rebuild in 1998, now the bank wants it. How can I stop it? My husband made a payment arrangement with the CT State Marshall for back taxes to which we are paying, But that's not good enough for Fairbanks. Made a payment arrangement with Fairbanks to catch up (only 2 months behind) they said OK, the day comes to put the check in the mail, and we get served court documents. We were not notified of such procedure going to take place. My husband has been on the phone trying to play "Let's Make a Deal", they tell us to keep calling back etc. And so we do. 4 Days later, NO idea on amount they want upfront so we can hang on to the house.

Now they say, call us back when you get your tax return. Which will be after our first court date. We asked about sending a payment, they refuse to accept payment from us, they will just mail it back they said. What do I do??? I have already tried to refianance, Fairbanks held back payoff information in a timely manner, so I was turned down, after a second credit report was pulled. Is anyone else out in CT, in the same Boat? I just may concider hiring an attorney in Connecticut.

PS, I find it quite coinsidental that I received a Foreclosure notice along with 17 others in my area, now that this company needs the funds to payoff settlements. My Log home is worth $305,000 (unpopular in my area) and I only owe 197,000. Go figure?
