Feb. six months after a $5900 refinance, we applied for a NACA loan modification with BofA, formerly Countrywide. Qualified, met all guidelines, kept a chronology of weekly calls of status to BofA 3-12-10 BofA fedexed us a modification offer with a return date of 3-18-10 and a payment required of $1125.64. I immediately contacted NACA to approve the offer, and the earliest available NACA counselor appointment was 3-18-10, then called BofA and spoke to Vonda Griffin, a modification supervisor who assured me to would be fine to return the notarized documents with the check the following week, after March 18th, after I spoke to NACA. On 3-18-10 Christine of NACA stated the offer looked good, so my husband took time off work that same day and we went to get the paperwork notarized and sent it off with a cashier check of $1125.64. I continuously phoned BofA for the status, and was told the same thing each time I called: everything was fine with the modification, they verified that they had received the signed papers with payment on 3-22-10, and I should be receiving the final modification papers by fedex shortly, they are just really behind and it just takes a long time for the paperwork to finalize. I requested proof of the status in writing. I received a letter dated 4-9-10 stating: they had received my signed documents, and they are in the final stages of completing the modification, and I was a valued customerthere at BAC HomeLoans Servicing, LP, and it is their continued goal to provide their customers with the highest level of customer satisfaction. If i needed further assistance, I could contact their Home Retention dept. Directly at 800-669-6650. No paperwork in May. At the end of May I was told by more than one BofA rep. That I should just make the payment date noted on the modification, { June} regardless if I receive the finialized documents. The only reason I haven't received them yet was because they had so many modifications to do and they are just really behind.in May, BofA told me the name of my negotiator and her direct number and extention, I attempted to reach her but noone ever answered and there was no way to leave a message. I was able to have representatives email her, to return my call, numerous times, 3 or 4 reps emailed her to call me, but she never answered any of the requests, and they were not allowed to give me her email directly. We made June and July's modification payment and on July 31st we receive a letter from BofA stating we were denied the loan modification due to not returning the paperwork by the specified date. I felt sick to my stomach, then I called BofA and I was told that I've been denied due to not returning documents by 3-18-10, and there wasn't anything I could do about it, I then asked to talk to a supervisor and she was even more unprofesssional, she said she didn't care what anyone else has told me at BofA, they had proof from Fedex that they mailed me the offer on 3/12/10 and they have proof from Fedex that I returned the documents on 3/22/10, not by 3/18/10 as stated on the offer, that BofA can lie and tell the customer anything they want, the worst that could happen to them was a mere slap on the wrist for lying, and it didn't matter what that NACA counselor stated by law, the banks have to give you adequate time to return paperwork, and went on to say, " It doesn't matter what NACA states, they do not matter". The felt complete dismay. I hung up the phone and couldn't breathe, I had a asthma attack and my husband took me to emergency where I was for 2 hours on a breathing machine. The following week I made an appointment with NACA and told me that I needed to re-fax all my paperwork to them because they have to have current paperwork every 3 months, even if nothing has changed they still need it all faxed to them, current dates on the paychecks and bills. Etc. So I did. But my gut told me that NACA was really on the side of the big banks not the hard-working homeowner. I decided to hire a private Loan Modification Company.
