I David have made no less than four submissions to Litton Loan Servicing to be considered for President Obama's Home Affordable Modification Program ("HAMP") since the beginning of 2009. Our applications have consistently been rejected by Litton Loan Servicing with inadequate responses that we believe violate the guidelines of HAMP.
In addition to the disregard and incomplete review of our HAMP submissions, at several points Litton Loan Servicing has giving us confusing and inconsistent assurances that a loan modification offer has either been mailed or has been approved and will shortly be mailed. But no loan modification offer is received by us, and we only then receive a denial or a new request to submit a HAMP application to Litton Loan Servicing.
Despite paying nearly one-third of the purchase price of the property in cash, we were charged excessive "points" by the lender; our assets were inflated on the loan application; our income was inflated on the loan application; we were told their loan would be a fixed rate mortgage; and the mortgage payment did not leave us the ability to afford both mortgage payments and living expenses. But for the misrepresentations made by the lender about the terms of the loan, we would not have entered into this loan. But for the inflation of our assets and income, and the charing of excessive "points, " this loan would not have been approved.
If we were offered a HAMP modification we believe we would be able to get back on track with our loan payments.
