It has come to my attention that you are missing payments that I have made to my account. Please find enclosed a printout from my bank, Wells Fargo Bank, of the payments to your company from my bank that were cashed. As you can see I have made a total amount of payments since 06/02/03, of the amount of $610.00.By my total calculations for the year I have made total of $1,010.00 to your company.By my records this is $50.00 over what 12 months of payments at $80.00 would be.

I received a call from your collections department, and please check my records to find out the operator as she was very rude and argumentative, today and was just told you did not receive my October payment that was sent by my bank on 09/15/03.in addition another payment was made on 10/31/03. Now I am told you have not received my December payment of $75.00 made on 12/01/03. Needless to say I am very upset and wish to dispute these payments in addition the $35.00 charges I keep getting because of the failure to process my payments in a timely manner.

Since First Consumer National's closure I have had nothing but problems with this account. And to find out today that your office has no customer service department to call was flooring. Prior to your take over of my account there were a couple of problems with the closure of FCNB, however otherwise I have an excellent payment history with Spiegel, and I am getting tired of this reflecting on my credit report and getting calls from your collection agency. The operator also said that your office would not stop calling unless I disputed the whole balance, which in this case since all the past due charges and payments you didn't post to my account is included in said balance.

I want this matter cleared up immediately and I want all calls to stop until after we have been able to clear this matter up. I will interpret any more collection calls, as harassment and I will not hesitate to take the appropriate legal steps to stop the harassment.
