Due to multiple medical emergencies I contacted our mortgage company in the early fall of 2009. We have had our mortgage with Citimortgage since July (fov over 10 years). We requested that three payments be moved to the end of the loan. We were assured by telephone that this would happen. This began a long continued nightmare in which CitiMortgage has foreclosured on our home with fraudulent practices and taking certain action without proper service and notification.
When I inquired about payments not clearing the bank I was told that CitiMortgage had begun the initial phase of possible foreclosure and would require that I catch all the payments up to date. I was told that there was no such record of any agreement to move payments to the end of the note. I was then told that I would be a good candidate for modification programs which would remove late payments from my credit record, remove any foreclosure attorney fees and provide some relief for me and my family. I then applied for two programs. I did not meet criteria for the "hopenow" program but that I was prequalified for another modification assistance program through Citimortgage but managed but an outside third party.

I received the application in the mail and forwarded it. My wife and I were shocked when we received notification that our house had been foreclosed on in April as we had not received proper service or any specific information that such court proceeding had begun. We immediately called CitiMortgage who assured us that they would not sell our house as long as we were under modification review. I inquired about paying money to reinstate the loan and was told then, as well as mulitiple other times, that IF I paid an estimated $700 (our mortgage payment is in the lower 300s) and agreed to higher payments of around $400 plus a month then I could get the home out of foreclosure status rand reinstate the loan. HOWEVER, if I got the loan reinstated then I would NOT qualify for the MODIFICATION and my credit history would show the current foreclosure status and late payments whereas the modification would remove all of this.

In the summer I inquired about the status of the modification mulitple times and was told that it had not been reviewed yet because of a backlog. All along there are these two proceedings, foreclosure and modification review. I then was told multiple times that more documents were needed because either they had been lost, or sent to the wrong department or more updated items were needed such as the most recent pay stub.in August, September and October I spent suabstantial time on the phone with many different people associated with Citimortgage, "that's not in my department anymore" "but it looks like" is a common response. I was told in September/October/ November that my modification was still under review. As late as October I was again given an estimate of about $875 to get my loan reinstated if the modification was denied.

A sale date was set for December 7 as I was notified about this the end of November. From this point on everything became a nighmare. Numerous calls resulted in "call this person" now. The third party handling my modification documents had subsequently been "fired" and Citimortgage was going to go ahead and sell my house. I was ready to go ahead and pay $875 to reinstate the loan on December 7 and was told now that I would have to have over $6000.00 on December 7 or my house would be sold. I indicated that I could comeupwith over $1000 or $1500 that day but it would be impossible for me to get $6500 or$7000 on two hour notice. I offered to pay over $1000 that day and $6000in January but they demanded it all NOW. I took off from work and spent all of December 7 at the courthouse. I met with people gathered for the auction. I met with the assigned trustee who told me, "we have a buyer already and we are going to sell it." I went befoe a judge on court record who did not grant a restraining order that I requested to stop the sell but recommended that I get a lawyer because of what he termed "fraudulent" practices.

I am now offering to pay Citimortgage $7200 in a cashier's check to resinstate the loan. During this entire time I have paid the property taxes and homeowner's monthly payments which are seperate payments. I have filed a complaint with HUD and the Attorney General's Office. It is my belief that since my house hascounty tax appraisal which is about twice the amount of the loan that CitiMortgage has decided to profit and make thousands of dollars of quick money and not honor promises and commitments made by numerous employees acting as their agents. If nothing is resolved through my HUD complaint immediately then I will file a lawsuit.
