Ripoff Foreclosing on a grandmother and granddaughter unlawfully in Ohio, We don't want to lose our home

A desperate plea from 2 local Cincinnatians...

Hello,

My name is LaVette, and I live in Cincinnati, Ohio.

It has taken me great courage to sit and write this letter, but I feel I have no other alternative than to plead to anyone that will listen, for help to save my grandmother's and my home. We have lived here over 34 years, and because of a nasty crooked mortgage company called HomeEq Servicing Corporation, in 8 days, we will literally be thrown out of our home, due to the foreclosure auction scheduled for 12/04. We have no where to go, and nowhere to put our stuff (furniture, valuables, etc.) at, and we are so scared.

We gave the last of our money to Assured Foreclosure Services in the amount of $995.00, to help us with options to save our home, but now they are calling us, telling us to come up with $12,000.00 up front to give to HomeEq, in order to pay up our loan, and make it current, THEN they will negotiate with them. We DON'T have that kind of money.

HomEq has added on SIGNIFICANT charges, which got TOTALLY out of hand since THEY did not want to negotiate with us in the first place, when it was only 1,500 dollars that they wanted last year. We TRIED to send over 1,300 dollars to them, and they DID NOT want it, and sent it back! Then they REFUSED payments the rest of the year, which we were very capable of sending in, and that made THIS situation WORSE.

What ticks me off, is that we made payments ALL THIS YEAR with NO PROBLEMS, and they accepted them without complaint, till October! That is over $4,300.00 worth of payments this year, that we paid out to them, and that means nothing. It PROVES that we CAN make our payments to them! So why can't they tack this money owed onto the end of the loan, then extend the loan a bit, and let us resume payments? Is that so difficult to do? They are just backing us into a wall, and I just don't know what else we can do!

HomEq has had numerous lawsuits, complaints, cases against, and suits brought against HomEq. They are so numerous. We are NOT the only ones they have treated very poorly, and totally unfairly by them. We did all we could to try to pay this arrearage back to them last year, but nothing we suggested or tried to negotiate to do made them happy. They refused 3 payments last year, which brought us from 1 month behind to 4 months behind, then they proceeded with foreclosure proceedings, and refused anymore payments the rest of last year. So now they are accusing us of being 11 months behind. This is ludicrous, since we were perfectly able to make our payments last year. We have over 39 money orders to prove we made our payments from 2000 thru 2003.

Also, we have NOT been served the copy of the lawsuit. Nothing at all. Just a sheriff sticker on our door telling the time and date of the auction. That's it.By my rights, I am entitled to know about the lawsuit and must be served with a copy of it before HomEq can proceed to sell my home.

I have read this on a government law site:

A.: When your lender refers your case to an attorney for foreclosure, the first step is an examination of records at the courthouse to identify all persons who may have an interest in your property. These will include the borrower (s), spouse (s) of the borrower (s), and any co-signers of the loan. Anyone who has some type of ownership interest or lien against the property also will be included in the case.By having all interested parties involved in the case, the court can make proper decisions that are binding upon everyone concerned.

Once the case is filed, the court will send you a copy of the lawsuit by certified mail and/or through delivery by a sheriff's deputy. You are entitled to know about the lawsuit and must be served with a copy of it before your lender can proceed to sell your house.

Like I have said before, we CAN make our mortgage payments. I cannot help that HomEq continually REFUSED our payments 11 times last year.in fact, had they not started this foreclosure and negotiated with us like we wanted this year, then they would have gotten over $914.00 dollars in the form of two payments from October and November, but NO they REFUSED those too.

I have reported them to the BBB and to the FTC.

My grandmother has never relied on me to make her house payment, she has ALWAYS taken it out of her Social Security check each month, and sent it to them. I cannot help that last year they sent back 3 payments and caused us to become 4 months behind instead of one! Then refused further payments since they put the home in foreclosure last year, which we had to fight tooth and nail like this year to keep it. Now they want those back payments that they refused to take during all of that, last year! Making us sound like we are just vagrants that can't pay our mortgage.

They would have gotten a payment each month last year, had they not started the foreclosure on us! Just like they got a payment for EVERY MONTH this year, which totaled about $4,300.00, until they refused payments this October and November!

They want this house, and the money they know they can get off of it. We now have 8 days left!

I have written to many charities, Community Chest, United Way, HUD, BBB, Veteran's Chapter since my grandmother is the widow of an veteran Marine in the 2nd Division of WWII, The Office on Aging, Housing Opportunities Made Equal, etc. I have also written to my local news stations, and even went as far as writing to Oprah and Montel Williams about this. I've even posted my plea on a Fund Raising.com site. Not to mention putting a website together, asking for help, explaining my dire situation. I have written to lawyers as well. All I get is either "Sorry, can't help you." or suggestions of more places to e-mail or call for help, which come up as dry as the places I have just mentioned. I have even recently written to the Mayor of Cincinnati.

I just don't know what else to do! I rarely sleep, and up all night working on this stuff, then nap a couple hours in the late morning, and get up and start all over again. My health is worsening over this extreme stress that I endure each day. I check my mail and get nothing but dashed hopes.

We just want to save our home.

How this company can be so cold as to want to put a grand daughter and her grand mother out on the street in the cold and during the holidays, is beyond me! Not to mention putting a widow of a veteran Marine who fought for our country for 4 years, out on the street. My grandfather would be APPALLED at how his wife and grand daughter are being treated right now, if he were still living. Especially when we CAN make their monthly payments.

I am 31 years old, and in ill health. I have to go get checked out soon by a doctor, since I have all the symptoms of maybe being a diabetic. My weight is at 100 pounds, and that is underweight for a person of my height, which is 5' 7". I have been ill for a couple years and unable to work. I worked for over 10 years, bringing in an income and helping my grandmother with her bills. We did fine, till my health began to fail 2 years ago, and even Medicaid turned me down for help. As I said, with all of the stress I have been under due to this situation, my health is worsening by the day.

As I have said too, we have called loan companies, mortgage companies, written to charities, news stations, and local organizations asking for help, and none seem to want to help us, since our home will be going up for foreclosure auction on December 4th. Which, from today, 11/25/03, is 8 days away. Our family cannot help us. Even our friends can't help us either, nor our neighbors. We shouldn't have to pay this kind of money up front. HomEq has denied payments last year, when we had the monthly payments to send them, and now they are trying to say that we are 11 months behind and it is OUR fault. They tried to foreclose on us last year but we fought it and won. Now they are at it again.

I sit and sob, unable to comprehend losing a home that I've lived in for 31 years, and my grandmother has lived in for over 34 years. She bought this home 34 years ago with her husband, in 1968, who was a veteran Marine in the 2nd Division, and in World War II, fighting in all of the big battles overseas. Back in 1968, they had 2 young children. Those children grew up in this home, and moved on to build their lives in other cities. But my grandmother and grandfather remained here, till he passed on due to a heart attack back in 1987. My grandmother and grandfather adopted me when I was just a child, since my parents were unable to care for me. They raised me in this home, all my life, and helped me get through school. So I really want to save this home for my grandmother, since I owe that to her, for all she's done for me, for all of these years. We have lived in Cincinnati all of our lives, and we love this city. We want to stay in this home, in this great neighborhood in East Price Hill.

This home is where my roots are, and where my grandmother's roots are, and we love it with all our hearts. I take care of the yard and gardens for my grandmother, since this home has a beautiful backyard that looks like a park. I also help my grandmother with chores and such, since she is unable to do too much, due to her heart condition. It is a wonderful street that we live on, with great neighbors on either side of us, that are so kind and helpful. We are content here, and don't want to leave.

My grandmother is 77 years old, and like I said earlier, she has a heart condition, and had a heart attack about 6 years ago. The stress of this impending foreclosure is wearing on her, and I fear that if it goes much further, she might have another heart attack, due to the intense stress. I don't want to lose her, along with our home. I would be more than devastated.

We just don't know what to do. If you can help us in any way at all, through advice on who we could turn to for help, or look into this, my grandmother and I would be so grateful.

We only have 8 days left!!!

We don't want to lose our home. We want to live here for many years to come, and keep up with the traditions here, that have gone on for over 34 years. I want to raise my family here in the future. I want us to be able to spend the holidays in this home this year, and for many years to come.

I just don't know where else to turn. I am alone in taking care of all this for my grandmother, since she is too nervous and unable to understand all the legalities and such. But it is just putting such a strain on me now, that I am not sure how much longer I can keep fighting this day in and day out. This mortgage company is horrible, and I hope that we can find someone to help us stop this foreclosure, then bring a lawsuit against them. They need to be stopped. They have hurt and ruined so many people's lives, and we are their current victim.
