In 1999, my mom and dad signed a loan with HomEQ, which was then The Money Store. My dad, who was the buyer (my mom the co-buyer) signed a credit life insurance agreement which stated that in the case of my dad's death, the house would be paid in full. Unfortunately, in June my dad passed away.
About a month after this, my mom faxed a copy of the death certificate to HomEQ and they stated that the contract was no longer in effect because the agreement was made with The Money Store. Then they said that it was and that it would take 90 days to get the house paid off. Then last year they took my mom to court to override her bancrupcy so that they could forclose on her house because she wasn't making payments after my dad passed!
Anyways, it's been almost a year now and the only thing that got this company going to get my moms house paid was the threat of a lawsuit. Now, they're trying to tell my mom she still owes like $4,000. HomEQ sent her a copy of the check which was $62,000 and said that it would take 10 business days to be applied to the principal. When she spoke with a representative from HomEQ, they said that the pay off balance at the time of my dads death was $60,000. Tell me how in the world do you still owe $4,000 to an account that was paid a check for more than the amount that you owe and they sent you a copy of the check!?
This company is absolutely ridiculous and I can't believe that they are doing it to so many people and getting away with it! My mom lost her husband, the only thing she has left is this house and they spent their lives making it what it is! How can they do this?! Now we are at a stand still again and they want my mom to start making payments that are $200 more than the original loan payment. Wanna know something else that's bad? They got the loan in 1999 for $66,000 and after 5 years of payments they had only paid $6,000. Is this accurate?!
