Beginning October first of 2009. We were in danger of falling behind on our mortgage payments to GMAC. We checked the GMAC website to see what there was for us to do. Hays and Associates was the top link off the GMAC website. We figured if it was on the actual lender site, it was a good option.
We contacted Hays and Associates that day. We spoke to a Michael Deets. One of the first things this person told us was that if they took our case (for 3195.00 of course) was, that we should neither speak to our lender, nor pay our mortgage. Legally I am sure this is not something they are supposed to tell clients, he did sound as though. Oh I am not supposed to tell you this but...
I took him at his word, wrote out the three checks, each for 1065.00. We filled out the paperwork and submitted our package, notified our lender that we were using a third party to neotiate on our behalf. At this point all was well. Soon after, when phone calls to ask questions became necessary to keep track of where we were in the process, I we were assigned to one case manager after another. Emails would not go thru, they were upgrading their phone system etc etc. Basically a run around on an epic scale. I recieved a mortgage workout packet from my lender. I faxed it to my case manager, as I had been told that anything I received must be checked over by Hays and Associates before I could make any moves. I waited at least two additional months after receiving the packet... At least weekly calls to hays, etc. No answer, leaving messages, writing emails.
When I finally got an answer, I was informed that my case was no longer active in GMAC loss mitigation because of missing paperwork. Some of the calls I made during the duration of this fiasco were specifically to ask if there was any more paperwork needed to keep things rolling. I was assured, "oh no, we will let you know if you need to send anything additional." As one of the other complaintants on here said. I was assured I was in good hands and that they would not let me lose my house.
Here it is seven months later. I have been working with my lender for about a month. I only hope it is not too late to save my home. I have been reading the guidelines for mortgage mods and once the arrears is greater than seven months, the lender usually turns down the modification. So here I sit waiting for my lender to tell me I am going to be thrown out of my home, all because these charlatans made sure I did not speak to my lender for the duration of my dealings with them!!! Today I called the original number for Michael Deets, The recorded message informed me that they had moved and that they were now Hays law center. If you look around on usacomplaints.com you will find a rebuttal to another womans claim, saying she had the wrong firm. SHE DOES NOT HAVE THE WRONG FIRM either hays and associates or hays law center. BOGUS! Both of them.
