I have recently fallen behind on my mortgage payments and I requested a modification review w / BAC. I informed them the home was not my primary residence. I was told by BAC that they have other programs ie in house modification programs for homes that do not qualify under the HOPE program. I faxed in tax forms, bank statements, monthly bills sheets, hardship letter & pay stubs just as I was requested. I faxed this information in 4 times all to be told that I was denied for non-comliance for not sending in the paperwork. I was also told BAC would not call me I had to call them. I called them daily and each time I was told something different and given different amounts to pay etc. BAC waited until the 11th hour 6 days out from foreclosure to tell me I have been denied for non compliance for not sending in paperwork when the representative confirmed my paperwork was on file. Secondly, I was told I was denied b/c the home was considered investment property. I informed BAC that I had a tenant in the home previously and that I wanted to qualify under a in house mod program. It appears no one is listening at BAC they dont read the notes on the account they dont pay attention to me or what I submit they lose the paperwork etc. Then when it gets to the last minute they tell me its too late to qualify for any type of program. This is unfair I have called I have faxed I have explained and explianed all to no avail. Does BAC want the home to go to foreclosure? My income dropped by $50k in 18 months prior to this time I had perfect credit. I cant get anyone to listen to me. I'm writing HUD I'm contacting the VA fair banking dept etc to file a compliant.
