This is a collection agency that routinely violates debtors rights under the Fair Debt Collection Practices Act. They only accept payment through direct debit of a checking account and refuse to accept money orders or other forms of payment. When asked for a physical address, they refuse and get nasty.
In January of I took a payday loan through Paycheck Today. A week later, I was seriously injured in a workplace accident. I was trampled by about fifty to sixty kids running to see a fight. When the dust cleared, I had a foot broken in three places, cuts to my left leg and arm, and a staph infection in my left leg that put me in the hospital for ten days on my husband's birthday, no less. I spent seven weeks home on disability. Unfortunately for me when I returned to work, my district experienced a massive cut in state aid and I was laid off.
ARM started calling last summer, around the middle of August, but when they refused to accept a check or money order and wanted direct access to my checking account, I refused, saying we were at an impasse. I want to pay this, just not by allowing them access to my checking account.
Now this year, they have routinely called my in-laws' home, despite the fact that such contact is NOT permissible since they already have my location information. According to the FDCPA, they may only call a third party if they cannot find me. Judging by the fact that they call my home three to four times a day (also a violation of the FDCPA), they very clearly have my location information. Therefore, contact with my in-laws is illegal.
Yesterday, a rather snotty b&^%h by the name of Lisa Collins left a message on my answering machine that said, and I quote "It is imperative that you or your legal representative return a call to Lisa Collins. I have important information that requires your immediate attention. My number is 866-679-4046. Again, I strongly suggest that you return the call. You have exactly one hour."
I don't respond well to threats, so I called back to inform them that a cease communication letter had been sent, so I was checking to see if they received it. Mr. Hoffman and Eva Myers hung up on me when I asked for Lisa Collins. When I finally got Ms. Collins on the phone, I informed her of the cease communications letter and she said "That's what you called me for?"
Anyway, since this company is NOT licensed to operate in the city of New York, they cannot do anything to me. Still, this harassment is illegal and I spoke to an attorney already who is a friend of the family. Like Steve from Bradenton, Florida, I don't intend to get mad. I intend to get paid!
