I would like to say 1st off, similar to others are suffering but working very hard and slowly recovering with this chaotic economy. My fiancee and I struggled for a long time trying to bring our bills current. Now as we are rounding that corner, we found ourselves stuck in another rut. I have two mortgages and two car loans, everything on point or so we thought.
Last night repo-men forced entry onto my property by bending & pulling up on the frame lock rod and double gates, a repo-order sanctioned by Bank of America! I heard my alarm going off between 2 and 3 in the am. Quick to get up I ran to see who is stealing my car! Repossession??? Noooooo that's last thing I would've expected.
So this truck has my car hooked tears out of my driveway as my front tires are locked. With the screaming and burning of rubber awaking and embarrassing commotion, they almost hit my neighbors car in the road with tire marks to prove it. As I ran after my car in socks, sweats and a t-shirt, they ate the red light dragging, burning and smoking the wheels on my car! There's tire marks for two city blocks!
They eventually had to stop and I caught up with them. Upon approaching the truck I finally realized that theses guys were from a legitimate company. Hence no violent intents or actions ensued. They told me if I cooperated and gave them the keys then I could grab my stuff out of the car and they would help smooth things over with Bank of America. Right there I knew the bank screwed up somewhere. Without further delay I proceeded to extend the courtesy by going back to my house to get the keys. Upon returning, the two repo-men had gone. They gave me the slip!
Now with Bank of America ive been banking with them for a very long time. I have a year and a half left on this car and its a paid in full loan. I spoke to them bout 4 months back requesting an extension due to hardship. They emailed me a document that can just be digitally signed over the Internet and grant me that two month extension under the following condition, that a payment of 189$ be made by the 30th of that month. Well from that point on I made a payment of 477$, a full payment. From there on I kept with my monthly plan. During that time I had to make sacrifices. The house phone was one of them.
Well the bank continued to send me letters of needing a phone number. What am I gonna do? Naturally I disregarded these harassing letters because as far as im concerned as long as the bills are paid and I have my extension, the banks happy and im happy. I mean, I still get phone calls even days after I make payment to my mortgage company! It wasn't as if I need to hide, because the bank could see that full car payments were being made. There wasn't any notice of intent to recover the car, just monthly statements which get set aside cause my note is getting paid and I see the transactions online.
My last payments have been made inside the bank. I always ask the tellers "what amount is due" and its always the same... 477$ so the question is... Where is this repo coming from!? Well when I called bank of America they claim that payment for 189$ wasn't made so they dismissed my two month extension. Still I did not receive any kind of notice of this action. These extensions that are give work in the form of taking the amount you are in default and tacking it on to the end of your loan, while you make up the balance for the time of month you are in. Anyhow all I know is that bank of America sent their repo-hounds, forced entry onto my property, and repossessed my car for 189$ and no home phone.
I've called bank of Americas executive office and consumer protection. Neither have produce information on what type of legal recourse I may have. I mean, if it was me forcing entry on someone's property, even just to pass through. I would be charged with criminal trespass and breaking and entering and breech of peace. So why is it any different for a repo-man. Last I checked repo-men were not granted police powers.
So now my final thoughts leave me with, unlawful entry, and a bank that took my car over breadcrumbs, disturbed my neighbors, embarrassing my family, damaging a vehicle in the process, and most of all, do I or should I even want or try to get the car back and have to pay for it! What legal recourse do I have even if I do take the car back? My dogss were just out there diog their business before they came. What if those men broke into the back yard and my dogs that aren't too friendly, were out there and those men where attacked after entering? And what if my dogs escaped from the enclosed fenced and locked property and injured someone because of the repoman and bank of america. Who's fault would that have been? It just not right!
