I knew something was wrong when my previous mortgage company Temple Inland advised me of my new mortgage company and before I could get a payment off to them I had already received a letter from Fairbanks that I was 90 days delinquent!!! I was never late with my previous mortgage company and now upon transfer I was 90 days late??!!
This was in late August in December I noticed a discrepancy in my statement (thank God at least I was getting them) so I called and they said they had charged me a $150 corporate administration fee plus $. 12 interest due to my payment being late! But it showed right there on the statement that I wasn't late?! On December 27 I mailed them a letter requesting this to be investigated. On January 6 I got a call telling me that I needed to make my payment.
When I questioned her she checked her computer and found that the Jan 1 payment had been posted 100% to principal on December 30. I told her that was not my error! Her supervisor came on the phone and told me I better pay up! I told her I was going to do something about this fraud being perpetrated. I soon received a letter quoting RESPA and the need for 60 days to investigate this discrepancy.
After reading all the reports on this website, I think they are just buying time to try and foreclose on my property. Just today I received a delinquency notice in the mail. Phone calls and letters don't fix anything, even them seeing it in their own computer screens, it doesn't seem to sink in. Please, if anyone out there is considering a class action lawsuit against these jerks let me know, I'm in!!
